Ram Jethmalani moves SC against Karnataka Governor's decision


New Delhi, May 17 (IANS): Senior lawyer Ram Jethmalani on Thursday approached the Supreme Court in his personal capacity against Karnataka Governor Vajubhai Vala's decision of inviting BJP leader B.S. Yeddyurappa to form a new government in the state despite being eight short of a simple majority in the assembly.

A bench of Chief Justice Dipak Misra, Justice A.M. Khanwilkar and Justice D.Y. Chandrachud asked Jethmalani to mention his plea on Friday before the bench concerned.

Jethmalani, who had taken retirement from law practice, told the bench that the Karnataka Governor's order is a "gross abuse of Constitutional power".

The apex court early on Thursday after a midnight hearing refused to stall the swearing-in of Yeddyurappa as Karnataka's new Chief Minister.

Yeddyurappa took the oath as the Chief Minister of Karnataka on Thursday at 9 a.m. at the Raj Bhavan amid tight security.

The court, however, sought the communications which Yeddyurappa had written to Karnataka Governor informing him his election as BJP legislature party.

The apex court said that the swearing-in is subject to the final outcome of the matter before it.

The bench headed by Justice A.K. Sikri, while seeking Yeddyurappa's response on the petition by Congress and Janata Dal-Secular (JD-S) seeking to stall his swearing-in, has directed further hearing of the matter at 10.30 a.m. on Friday.

    Governor Has Acted as per Law. So no chance to anyone . He Had 2 Options .He exercised the one he Thought Most Suitable for situation. Even he favoured Bjp then also hes within his parameters. Only we can wish that Yeddy will Fail during Floor Test. Even JD(S)/BJP Forms Government latter Still BJP will play games and try to destablish. CONG/JD(S) must try to get some MLAS from BJP and form a strong alliance sothat no one will break it . Current Alliance is ooportunistic and may break since the numbers are bare minium.

    This is not the Governor’s own rule. The leader of the majority party has to be given the first chance to form govt. and prove his strength on the floor of the house. This has happened after Lok Sabha elections in 1996 when Mr. Vajpayee was invited to form govt. and had to step down after 13 days for not getting the required numbers.

    Well done Mr Ram Jethmalani. The Court should give a verdict to prosecute Governors who are abusing their office by not applying their mind and the constitutional provisions by giving arbitrary decisions. Unless a Governor is prosecuted things will not change. We will have umpteen number of judicial decisions each one used as a precedent only to confuse, and compound the problems. The immunity for the office of the Governor against prosecution should be lifted by the SC just like in the Corporate law the Veil of Seperate legal entity is lifted to identify a fraudulent act. Here in constitutional matters it is a fraud against the constitution and against the people of India. A mockery of the constitution and the murder of democracy which is repeatedly carried out by the BJP with the assistance of the lame duck, handpicked Governors.

    First of all, let me clarify that I am not defending Modi, BJP or the Governor. I am annoyed just like you are.

    Having said that, you say that "what Congress did not do, BJP is doing now". Really??? This whole mess with Governors puppeteering started back in the 70's by none other than Mrs. Indira Gandhi. She had dismissed non-Congress State Governments even when the Governments had absolute majority in the assembly. If you think I am kidding, just Google it and tell me if I am wrong. And the most famous Bommai case which everyone refers to now relates to Rajiv Gandhi dismissing Bommai’s Government.

    There is hardly anything that BJP is doing that the Congress hasn’t transgressed previously. Be it tinkering with unfavourable state election mandates, or using religion for political gains, or seeking gold medal for corruption. You name it and Congress has most likely already done it.

    Congress is no saint. And has Salman Khurshid recently said, Congress mostly certainly has blood on its hands.

    I am not a defence lawyer for the BJP or the Congress. So, if you ask me questions that starts something like “why this” “why that”, then I will just say kolaveri kolaveri and nothing else. You better ask those questions to either a Modi bhakth or to a Gandhi chamcha.

    And for your information, it is not just “one thing” Indira Gandhi did. Rather, it is one of the many things she did. But nothing can surpass the imposition of emergency. She was in power for more than 15 years and surely there are many things that she did good too.

    And of course, if people do not like Modi, even his Government will face the same fate as that of Indira Gandhi in the 2019 election.
