Cabinet nod for death penalty for raping children below 12


New Delhi, Apr 21 (IANS): The Union Cabinet, at a meeting chaired by Prime Minister Narendra Modi, on Saturday approved an ordinance on the death penalty for those convicted of raping children below the age of 12.

The decision came a day after the Ministry of Women and Child Development told the Supreme Court that it was proposing the death penalty for those convicted of raping children.

The Ministry had told the apex court that the government was "sensitive to the plight of young children" brutally abused in the most horrific manner, and proposed to amend the Protection of Children from Sexual Offences (POCSO) Act by introducing the death penalty to the convicts of child rapes.

The Cabinet move came in the backdrop of nationwide outrage over the rape and murder of an eight-year-old girl in Kathua in Jammu and Kashmir, and other instances in different parts of the country including a nine-year-old girl in Surat.

The POCSO Act was formulated in order to effectively address sexual abuse and sexual exploitation of children.

    2 major problems with this.

    A. Victims will now be in greater danger if the penalty is death.
    B. Given the flippant ways in which accusations are made and evidence is gathered (or not), can anyone say with certainty if an accused is guilty and correct justice will be served?

    Implement what laws we have.
    Stop female foeticide and restore the natural ratio of male to female in India.
    Women and children are full and equal citizens of this country and should be treated with no watering down of their equality.
    The move being considered will cause more harm than it will prevent.

    We don't want any new laws. We have sufficient laws. Please implement upon judgment. The drama of lower court will give death penalty, to the same case high court will give life imprisonment and supreme court will tell he is innocent MUST STOP. This is not only in India, go to any democratic country the same drama. See in Muslim countries with minimum witness they will close the case with in one year.

    It's really welcome and bold decision by PM. Now for those ppl who say it should apply to all age categories, I am not in favour just bcz ppl gonna misuse it. Imagine an innocent guy or bread winner of the fly falsely tagged in a rape....

    One thing atleast now our little angles of our fly who r below the age of 12 are saved from psycho rapist..

PM of india says he is from art of living, so what is the relevance? u stop cow killing, stop kill all animals then. stop being weird hypocrites! there are so many substitutes in life to gain something, and attain something without hurting others, OTHERWISE don't ask why this happened. If happened, immitating their acts won't solve anything, the criminals need to be caught and put into pro-rehabilitation centers. Grow up people!

    You are spot on ...Death penalty is an effective deterrent ...but some of the causes of sexual aggression maybe due to below .Every body raising and voicing their protest against the govt ...but nobody talks of effective remedies. more than the govt these are social issues..The govt can formulate policies and guidelines and acts ..but ultimately the society and people are responsible .
    .wide spread access to pornograghy and fetish.With the advent of free and low cost high speed bandwidth through smart phones ..the libido of men and sex strings of women is easily tickled.
    honor ,anger,economic factors,social factors,sexual purity,poverty are some of the contributing to rape.
    In most cases economic success too adds to immoral ,illicit,immoral relationships among'st adults.Add to this is drug abuse which is rampant in middle class and upper middle class families.

    Excellent point. If the State can award capital punishment to drug traffickers, it should also award it to rapists, and there should be no mercy or commutation of the death penalty if the victim is grievously injured (physically or mentally). or murdered. For these crimes against women and children 12+, amendments have to be made not to POSCO but to the Penal Code.
