Impeachment talks ‘unfortunate’, says SC hearing plea seeking gag on media


New Delhi, Apr 20(PTI): The Supreme Court on Friday termed as very unfortunate the public statements, including those made by lawmakers, on impeachment of judges.

"We are all very disturbed about it," a bench comprising Justices AK Sikri and Ashok Bhushan said after the counsel appearing for the petitioner raised the issue of politicians making public statements on impeachment of judges.

The apex court asked Attorney General KK Venugopal to assist it to deal with the plea, which has also sought a gag on the media from reporting such statements.

The development assumes significance as it comes on a day when the Congress and other opposition parties handed over a notice to initiate impeachment proceedings against Chief Justice of India Dipak Misra to Vice President and Rajya Sabha chairman Venkaiah Naidu.

The move comes a day after the apex court ruling in the CBI Judge BH Loya case.

However, during Friday's hearing, no reference of CJI was made during brief arguments.

The apex court, while asking the top law officer of the country to assist it in the matter, posted the case for hearing on May 7.

It, however, refused to pass any order gagging the media, saying it would not do this without hearing the Attorney General.

    Rather it is very unfortunate for the nation that you are not taking up this PIL case and the petition from the opposition and trying to put gag on media related to this case. CJI has breached other 5 major offences not including justice Loya's case so it is imperative for SC to give serious consideration to this case.

    Impeachment is the necessity when judiciary fails to deliver the justice.
    Impeachment has the constitutional validity.
    Impeachment last resort when Supreme Court credibility in question.

    Kasargod Ramesh,
    its the first time in India and just pay attention to one thing: Judge Loya's death.
    The case was heard by the bench where CJI was part of the bench that heard the case.
    When the PIL came, against CJI makes himself part of the bench that dismisses it. A wise judge would have assigned it to another bench who were not part of the original bench that heard the case. The wise thing for the CJI would have been to recuse himself in hearing the PIL.
    Very dangerous scenario where CJI assigns a case to himself and hears PIL challenging his own verdict. Is it just because you are the one to assign cases?

    Sir, Blind bhaktha don't only believes in fake news and fake videos. They don't have ability to understand the complex judicial proceedings.
    By rejecting the petition which challenges the earlier verdict of CJI Misra, he become part of the murder accomplice.
    It is unfortunate that Supreme Court credibility for the first time in the history of India come to so low.

    BJP interrupted only in few cases where major scams erupted. You cannot equate the two. Since the beginning of this loksabha, Congress has decided to disrupt every parliament session for any small reason.

    FYI, congress along with opposition is waiting for clarification and explanation from the ruling party within the parliamentary and democratic norms whereas BJP disrupted parliament session in unparliamentary and rowdy way as protest for answers and clarification by congress which would expose BJP and become threat for BJP survival and popularity.
