2002 Gujarat riots: Ex-BJP min Maya Kodnani acquitted in Narodia Patiya case


Ahmedabad, Apr 20 (IANS): A Division Bench of the Gujarat High Court on Friday acquitted former BJP Minister Maya Kodnani, saying there was absence of sufficient proof of her presence at the crime scene in the Naroda Patiya massacre case of 2002.

The court also upheld the conviction of Bajrangi Dal activist Babu Bajrangi, who was sentenced to imprisonment for life by the trial court.

The Bharatiya Janata Party Minister was one of the key accused in the riot case and was convicted by a special SIT court in August 2012. She was sentenced to 28 years in imprisonment.

The judgment was pronounced on the appeals filed by the former BJP Minister and others against their conviction by the SIT court.

The Division Bench of Justice Harsha Devani and Justice A.S. Supehia upheld the conviction by the special court of Babubhai Patel alias Bajrangi, a prominent leader of the Bajrang Dal Hindu outfit.

He was a key conspirator in the massacre in Naroda Patiya area, where 97 Muslim persons were killed in the Godhra aftermath.

The Naroda Patiya riots was one of the worst incidents during communal conflagration that engulfed Gujarat, following the train burning incident on February 27, 2002, at Godhra in which 59 Kar Sevaks were killed.

The High Court in August 2017 had reserved its order after the hearing concluded against the judgment of the special court.

The special court had sentenced 32 people, including Kodnani and Bajrangi. Seven others were given enhanced life imprisonment of 21 years, which they will serve after undergoing 10 years' imprisonment under IPC section 326 (causing grievous hurt).

The remaining accused were given simple life imprisonment of 14 years.

The trial court's acquittal of 29 other accused in the case, for want of evidence was challenged by the SIT, even as those convicted had challenged the lower court's order in the High Court for respite.

Government counsel Prashant Desai said: "It is clear from the Gujarat High Court's judgment that the court has gone on no witness theory."

"Twelve accused have been convicted. Besides Babu Bajrangi, Prakash Rathod and Suresh Chara alias Suresh Langda have been convicted under the IPC 120 (B) as key conspirators.

"The sting operation by the Tehelka was not taken into account by the court. The 12 have been convicted with 21 years imprisonment without remission.

"Whatever Babu Bajrangi did was no different from what the others did, so his conviction was on parity. Court believed police witnesses."

"On Maya Kodnani, there were contradictions in the witnesses' testimony against her presence at the crime scene. None of the police witnesses have said that they saw Kodnani at the scene.

"The SIT will have to appeal within 90 days to the Supreme Court if they want to challenge the Gujarat High Court verdict," added the counsel.

Deputy Chief Minister Nitin Patel said: "Our minister Kodnani was wrongfully implicted in the Naroda Patiya massacre case. But today after the Gujarat High Court acquittal, she has been found innocent."

"We are happy with the verdict and welcome the decision. She has worked hard for the party and definitely she will be given an active role in the party if she wishes to continue."

Meanwhile, the state BJP president Jitu Vaghani has blamed the Congress party for arraigning Kodnani in the case. "The Congress wrongfully involved our former minister."

Sanghi moles who are placed at top are pronouncing judgement to please Daku -Feud...Even Pakistan ,Bangladesh hangs culprits but here extremists are rewarded with minister post and we make them as our leader becoz our society is completely rotten beyond repair...
    Last time the judge who absolved Aseemanand was from ABVP-BJP background... You now know how our dear leader got clean chit in past to become PM. If it was in west he would have been awarded life sentence ....

This is nothing but mockery of Indian justice system and people have lost faith in almost all govt institutions. A very bad development which will boomerang on BJP very badly and it is unavoidable.

    Anuradha Biyani, the sister of the judge Loya, echoed that sentiment.

    “Kya bolun ab (What should I say)?” said Biyani. “Jo ek vishwas tha woh bhi ab nahi hain. Kuch bolne ke jaisa rakha hi nahi hain chaar saal se ab kisi ne. (There is no hope left. For the past four years, we have been left with nothing to say).

    videos of Babubajrangi easily available in youtube enough to prove send maximum bjp frontline leaders to the gallows. Shame on corrupt Indian jusicials. A lay man can judge how bjp shileding rapists and murderers.

    This minister Doctor by profession has seen with gun attacking 'Narodia Patiy' one of the worst massacre that took more than 48 peoples death all Muslims.

    When Chief Justice of India and credibility of the Supreme Court in question what can we expect for justice for the victim.
    Yesterday it is Supreme Court overturned the petitioners plea in fake encounter case, despite court aware of petitioner Shalini and Judge Loya and two other lawyers murder.
    Day before in Mecca Masjid blast Swami Assemnd acquitted despite his open confession to interview to Caravan magazine represented by lawyer who is former member of Akhila Bharatiya Vidyarthi Parishad(ABVP).
    Today it is convicted criminal May Kodnani and Babu Bajrangi.
    Certainly India is heading in the direction of Mexico run by Mafia.
    RIP India's Judiciary!Lady of justice is not permanently blinded by BJP forever just like Kashmir's with pellet guns.

    Loya death ruling a black day in Supreme Court history, says Prashant Bhushan
    "Black day in Supreme Court's history," fired senior advocate Prashant Bhushan over the Supreme Court's verdict of quashing pleas seeking SIT probe into Judge Loya's death case.
    After the Supreme Court today dismissed all petitions seeking an SIT probe into the death of special CBI Judge BH Loya, senior advocate Prashant Bhushan called it a "black day in Supreme Court's history".

    Prashant Bhushan is one of the petitioners who sought an independent probe in the case. While addressing the media after the Supreme Court pronounced its verdict, Bhushan called it "extremely disappointing".

    Expressing dismay over the dismissal of pleas, Bhushan said, "The Supreme Court bench headed by the CJI dismissed the petitions saying there is no reason to disbelieve the two Bombay judges who said that three judges slept in the room with two beds (without signing affidavit)."

    SC bench headed by CJI dismissed the petitions seeking Indep Inquiry into Judge Loya's death,saying there's no reason to disbelieve 2 Bombay judges who said(w/o affidavit)that 3 judges slept in room with 2 beds. This despite the ECG &Histopath report falsifying Heart attack story

    Reportedly, Bhushan also quoted BH Loya's medical report and fired that the "ECG and Histopath report falsified Justice Loya's heart attack story."

    The three-judge Supreme Court bench observed that there was no reason to doubt the statement made by four judges who were there with Justice Loya at the time of his death and they are of the opinion that doubting their statements would amount to doubting the integrity of the judiciary.

    Special CBI Judge BH Loya was earlier holding a trial in the Shorabuddin Sheikh fake encounter case. As per official records, Justice Loya died of cardiac arrest in Nagpur in 2014, a day after he attended the wedding and reception of his colleague's daughter.

    i think before tenure of modi ,all case of communal party cadres will be dismissed.. Indian's never thought modi regime will go such low level in law execution, intervened with judges and court and making partiality for particular community. this system will to lead to anarchy. the people for whom justice denied may go violent and take extreme steps against the the real culprits who escaped through court.
