BJP alleges Rahul Gandhi's 'invisible hand' behind Judge Loya death case PILs


New Delhi, Apr 19 (PTI): The BJP on Thursday mounted an attack on the opposition Congress after the Supreme Court rejected pleas to probe the death of Judge BH Loya, alleging that the "invisible" hand behind the petitions was that of Rahul Gandhi who tried to use the judiciary for "character assassination" of Amit Shah.

The Supreme Court on Thursday ruled that Judge Loya died of natural causes and that the petitions were serious attempts to scandalise and obstruct the course of justice.

Addressing a press conference, BJP spokesperson Sambit Patra described the PILs seeking the probe into the death of Judge Loya as "political interest litigation", and charged that Rahul and his party were behind it.

Noting that the Congress had held press conferences and Rahul had led a delegation of opposition parties to the President for seeking a probe, Patra said he should "apologise" and be "ashamed" for his conspiracy to target Amit Shah, and Indian judiciary and democracy.

The Congress engages in all sorts of conspiracies after its ruling family loses power, he alleged and added the attempt to use judiciary for political purposes was a "new low" in Indian politics.

The "invisible hand" behind these petitions in the top court belonged to Rahul and the Congress, Patra alleged.

Reacting to the verdict, Union Home Minister Rajnath Singh said, "The Supreme Court has also cautioned against the misuse of courts in political tug of war. The SC verdict gives a clear message that the judiciary cannot be misled by allegations based on political vendetta."

The issue of Loya's death had come under the spotlight in November 2017 after media reports quoting his sister had fuelled suspicion about circumstances surrounding it and its link to the Sohrabuddin case, which he was hearing before he died.

Amit Shah was an accused in the case but was later discharged. Several activists and opposition parties had alleged a foul play in his death.

While dismissing the plea for an independent probe, the top court said that with these petitions it becomes clear that a real attempt and a frontal attack was made on the independence of the judiciary. The top court said frivolous and motivated litigation has been filed to settle political rivalry.

    Under Modi Sarkar people have lost faith in institutions which are behaving like Caged parrots obeying their master's voice. Some paid media are also under a huge cloud of doubt. Now what we feared most is that doubts over pockets of the judiciary have also come under a cloud of doubt. Thanks to the most unfit in 70 years Modi Sarkar for the pathetic state of affairs today.

    6.There is no entry or record of Judge Loya having stayed in the occupancy register of Ravi Bhavan, Nagpur on November 30, 2014. Fifteen employees posted in Ravi Bhavan, Nagpur did not even recall that Judge Loya ever stayed in Ravi Bhavan.

    7.There was no reason for three judges to sleep in a room with only two beds when adjoining rooms were empty. Why did the 15 members of the staff then not know either about the stay or the heart attack? Why were no entries made in the occupancy register?

    8.Family of Judge Loya has publicly stated that clothes on his dead body had blood stains, especially near the neck area.

    9.Post-mortem of Judge Loya was conducted on December 1, 2014 without information and consent of any immediate family members. There were discrepancies even in recording name in post-mortem report.

    10.Two of the other colleagues of Judge Loya, who were allegedly informed about the pressure being put on him, also died under suspicious circumstances. One associate, advocate Khandalkar body was found in district court, Nagpur after alleged fall from the eighth story on November 29, 2015. (November 28, 2015 was closed court work and he was missing for two days). Second associate, retired Judge Thombre died in suspicious circumstances while travelling in train from Nagpur to Bangalore on May 16, 2016. There is no FIR or an investigation in these deaths till date. One advocate Satish Uke, raising the issue narrowly escaped death when on July 8, 2016, heavy weight iron material of 5,000 kgs fell on his office.

    Saying that only an independent probe can decide whether Loya’s death was natural or not.
    Can statements of some judges made in an administrative enquiry before a police officer be the sole yardstick for arriving at a conclusion, more so when there is suspicion being raised by available forensic evidence, opinion of experts, documents,discrepancies and statements of various witnesses given to different organisations pointing towards a possible conspiracy?

    The Supreme Court today dismissed the petitions seeking an SIT probe into the death of Judge B.H. Loya.
    There are10 apprehensions and questions surrounding Loya’s death:

    1. Sohrabuddin/Tulsirram Prajapati fake encounter case was transferred from Gujarat to CBI court, Mumbai by the Supreme Court in the year 2012, directing that same judge will preside over the trial from start to finish. Judge Utpat was designated as special CBI Judge in Mumbai. He allegedly reprimanded the accused for not appearing in his court and fixed the case for June 26, 2014. A day before, on June 25, 2014, he was abruptly transferred. Judge B.H. Loya was posted in his place. Judge Loya died in suspicious circumstances on November 30, 2014. Post that, shri Amit Shah has been since discharged and CBI refused to file an appeal against the order of the discharge.

    2.Sister of Judge Loya gave an interview to a media house on November 21, 2017, to allege that he was being offered a Rs 100-crore bribe plus residential flat/property in Mumbai for delivering a verdict in favour of the accused by a former chief justice.

    3. Judge Loya was stated to have died on account of heart attack. ECG and histopathology report of Judge Loya showed no evidence of heart attack. On the contrary, Dr R.K. Sharma, ex-head of Forensics & Toxicology at AIIMS stated that there was no evidence of heart attack and there was evidence of ‘possible trauma to the brain’.

    4. Judge Loya’s security was withdrawn on November 24, 2014 in Mumbai and he was not provided any security as he travelled from Mumbai to Nagpur, where he died on November 30, 2014.

    5. There is no travel record of Judge Loya travelling by train from Mumbai to Nagpur.

    This is a black day in Indian Judiciary. Prashanth Bushan and others tried their best to present the case and loop holes in Judge Loya's post mortum and the way Amit Shah was acquitted. But the judges panel which presided this case are compromised. This is the reason why 4 senior most judges had to make press conference. And please dont take Sambith Patra seriously. He has lost control on himself and what he talks makes no sense. He and GVL Narsimha Rao are people who waste time on prime time news and talk on issues representing BJP where non of them are in power to do anything. The are just spokesperson . If this case was given to SIT for probe then it would have been a disaster for BJP. If Pakistan, Gandhis and Congress were not there what speech would have Mr. Modi given. Any problem since last 4 years is by Congress, Nehru, Gandhis and Pakistan. BJP govt has nothing to do with any problem this country is facing.

    If Amit Shah is innocent and justice Loya died of natural cause then why Amit Shah is putting road blocks and hurdles in this PIL???. After all it's Public Interest Litigation there is no question about settling political rivalry or political vendetta and SC should pursue this case on public interest.
