Bengaluru's global status earns Karnataka 4.75 tmcft Cauvery water


New Delhi, Feb 16 (PTI): Bengaluru's global status as a flourishing seat for intellectual excellence" and a "nerve centre of contemporaneous significance", whose demand for civic amenities is growing daily, has earned Karnataka 4.75 tmcft of Cauvery water to meet its requirements, the Supreme Court said today.

The top court did not agree with the findings in 2007 award of Cauvery Water Dispute Tribunal (CWDT) and said it had drastically reduced the share of Karnataka towards domestic and industrial purpose on the ground that only one-third of the city of Bengaluru fell within the river basin and also on the presumption that 50 percent of the drinking water requirement would be met from groundwater supply.

"The said view taken by the tribunal ignores the basic principle pertaining to drinking water and is, thus, unsustainable. Keeping in mind the global status that the city has attained, an addition of 4.75 tmc is awarded to Karnataka," a three-judge bench headed by Chief Justice Dipak Misra said.

With the today's verdict, the apex court raised Karnataka's current share of 270 tmcft Cauvery water by another 14.75 tmcft, including 4.75 tmcft water for drinking and domestic requirement of Bengaluru residents and 10 tmcft on account of availability of groundwater in Tamil Nadu.

The bench said that territorial or geographical demarcation for extension of beneficial uses of an inter-state river basin cannot always be strictly construed.

"We are inclined to think so as the perception of a basin state inheres in it a degree of flexibility in approach in a unique fact situation to justify a warrantable flexibility and departure from such rigoristic approach.

"We are disposed to think (that) for the city of Bengaluru, as an evident phenomenon, has burgeoned over the years and has grown today into a progressively sophisticated, sprawling, vibrant and a much-aspired seat of intellectual excellence particularly in information technology and commercial flourish.

"It has transformed into a nerve centre of contemporaneous significance and its population is daily on the rise, thus, registering an ever enhancing demand for all civic amenities," the bench, also comprising Justice Amitava Roy and A M Khanwilkar, said.

The bench said it will be inconceivable to have an artificial boundary and deny the population the primary need of drinking water. "We hold so in the special features of the case, keeping in view the global status the city has attained and further appreciating the doctrine of equitable proportionality on the bedrock of pressing human needs," it said.

The bench said it cannot approve the tribunal's approach and opined that the allocation of water for drinking and domestic purposes for the entire city of Bengaluru has to be accounted for.

It rejected the tribunal's assumption that 50 per cent of the drinking water requirement would be met from groundwater, the bench said 33 tmc would be a safe and acceptable figure qua drinking and domestic water requirement of the State of Karnataka for its urban and rural population.

The tribunal had quantified the total drinking water requirement for the urban and rural population to be 17.22 TMC.

Karnataka government had contended that while quantifying the allocation of water for domestic purposes, the tribunal had accounted for only one-third of the city of Bengaluru to be falling within the river basin and drastically cut down its overall share under this head.

    Expanding the city without proper infrastructure will ruin the cities character. Bangalore is no more a grander city. Why everybody wants to be in bangalore. IT and IT related industries should move out to other cities where they need air connectivity and they can have corporate office in the Capital. Even heavy engineering industries to be moved or at least new one to be started in other locations where road and sea transport is easily managed.

    We Indians are unbelievably corrupt. We Indians never see any problem with stealing or backstabbing our fellow Indians to make money by hook or by crook. We refuse to follow laws, common sense and any sense of human decency. We Indians are not that smart. If we were smart, we would not have let our country fall from grace since independence. The only thing that we Indians care about is ones own self interest and nothing else. We Indians dont have any honour, dignity or morality. We Indians make promises in a blink of an eye and break promises in the blink of an eye with complete disregard to fellow Indians. We Indians only want win-lose in any situation. We Indians have to win no matter what by hook or by crook and the other party must lose. We Indians are extremely professional when it comes to committing to mass corruption, mass encroachment, mass pollution, and mass population. In the olden days corrupt, greedy, selfish were looked down upon but today corrupt, greedy, selfish are praised and honest, innocent are looked down upon and frowned. Being honest and innocent is a grave sin in India today. We Indians love to loot and boot, encroach and boot, grab and boot and say We are proud to be Indians with full of lust, ego, arrogance, greed, selfishness, treachery, deceit and maliciousness. We dont even bother to accept our faults but retort with pride and ego. Truth and righteousness are dead in India. Untruth and unrighteousness alone triumphs for all Indians in India. We Indians have no conscience of the wrongs we keep doing every day. We Indians are one of the top most corrupt races in the world today. We Indians are brilliant drama kings and drama queens when it comes to conniving to harm our fellow Indians in such a way that each of us deserve an Oscar. This is about how majority of we Indians have fallen from grace. We Indians must realize our mistakes and change for the better. How can we Indians expect to become a developed country with mass corruption, mass encroachment, mass pollution and mass population.     I agree with both the Kumars but right now we Indians have to come out of our illusion of being greatest and start correcting our mistakes... spiritually we are great but we have to learn and practice many other things from developed and developing countries about cleanliness, better police force with modern approach,faster judiciary, population control, public health and higiene , preserving greenery , better city planning and many more things in order to give a decent quality of life even to the economically lowest category of people..

Now check the countries surrounding India in that ranking.... you will find that even those countries have similar isssues in regards to politics, standard of living, etc.

    You have mentioned how are country has gone downhill since independence.... well just a look at average IQ will give you the answers. ... Now ask yourself,

    Why do people vote criminals into office?? What can we expect from criminals once they get power?? Will they try to solve the countries problems or will they enrich themselves??

    When I said India is the greatest country in the world, I was referring to our Indian culture and customs. Our Indian culture and customs will always be unique in the world. Spirituality might not have helped you but it has helped people like me and others so much. It is only because of spirituality that some of us are not corrupted and we believe in being good and doing good to others. I will always respect the teachings of our enlightened teachers like Shri Adi Shankaracharya, Swami Ramkrishna, Swami Vivekananda, and many others.

    Political peoples and panchayat members In and around udupi district are totally blind about harvesting rain water, not building any mini dams, not renovating natural pounds, no rain water harvesters nothing...... only thinking about money making though construction of roads and buildings....
