Loya died of coronary artery insufficiency, say police citing post-mortem report


Nagpur, Jan 17 (PTI): Special CBI Judge B H Loya died of "coronary artery insufficiency", a senior police officer said today, citing the report of the post-mortem examination conducted on him at a Nagpur hospital nearly three years ago.

The investigation into the death case registered under Section 174 of the CrPC at Sadar police station, was closed after the post-mortem report received from the Department of Forensic of Medicine of Government Medical College and Hospital, which conducted the autopsy, the officer, who did not wish to be named, said.

"There was nothing suspicious in the histopathology report of Justice Loya," the officer said.

"As no poisonous element was found in his body as per the histopathology report and doctors confirmed the cause of death as coronary artery insufficiency, the Investigation Officer (IO) had closed the probe," he said.

According to the officer, the judges, who accompanied Justice Loya during the Napgur tour, had alerted the deceased's relative Rukmesh Pannalal Jakhotia, a resident of Aurangabad, that Loya had suffered a heart attack early on December 1, 2014.

"Jakhotia asked Dr Prashant Rathi, a resident of Ravi Nagar, Napgur, to visit the hospital after which Dr Rathi arrived at Meditrina Hospital at around 6am. Dr Rathi had accepted Justice Loya's body. Statements of Dr Rathi and doctors were recorded by the police during the investigation," the officer said.

Loya's body was sent to his village Gategaon in Latur district in an ambulance (MH-40/Y-8262) and a constable from Traffic Control Branch, Prashant Thawre (batch no. 554) and two judges followed the ambulance in their car, the officer said, showing documents available with him.

Three days back, Anuj Loya, the son of Justice Loya, who was hearing the sensitive Sohrabuddin Sheikh "fake encounter" case, had said that his family was convinced that his father died of natural causes.

"My father died of natural causes, our family is convinced it was a natural death...I have made myself clear that we do not have a suspicion...It was a natural death," Anuj had told PTI on Sunday.

Talking to reporters later, Anuj had said although he and his family earlier had suspicions about his father's death, they no longer harboured such doubts.

Justice Loya had gone to attend the wedding of a colleague's daughter when he died in Nagpur in December 2014.

BJP chief Amit Shah was an accused in the Sohrabuddin Sheikh case and was subsequently discharged.

Anuj's press conference had come two days after four senior-most judges mounted a virtual revolt against the country's chief justice, raising questions on "selective" case allocation and certain judicial orders.

One of the four senior-most judges, who held the unprecedented press conference last Friday, had said the matter involving judge Loya's death was one of the issues underpinning their differences with Chief Justice Dipak Misra.

    why make things complicated. when Gujarat model itself is encounter & crime, you can not tell its coincidence & wash your hands. from gujarat riots to supreme court bench fixing can be done. Why are you running away from proper investigation under supreme court . the previous order was to conduct entire investigation under one SINGLE judge. you violated every rule. when there are so many doubts even for judges, why run away & trying to avoid investigation...That itself shows the result of investigation.

    Significantly, two judges of the Bombay High Court, Justice Bhushan Gavai and Justice Sunil Shukre, who both went to the hospital that day and made arrangements for the transport of the body, have spoken to The Indian Express to detail the sequence of events. Both judges said there was nothing about the circumstances of the death to raise any suspicion.
    After the wedding on November 30, 2014, Loya was at the Ravi Bhavan guest house in the Civil Lines Area of Nagpur when he complained of chest pain around 4 am on December 1.
    Recalling the sequence of events, Justice Bhushan Gavai told The Indian Express: “Loya was staying with fellow judges Shridhar Kulkarni and Shriram Madhusudan Modak. He experienced a health problem around 4 am. (Local judge) Vijaykumar Barde and then Deputy Registrar of the Nagpur bench of the High Court Rupesh Rathi first took him to Dande Hospital (3 km from the guest house) in two cars.”
    “There was no question of taking him in an autorickshaw (as mentioned in the Caravan report),” said Justice Shukre. “Judge Barde drove him to Dande Hospital in his own car.”
    The Caravan report and judge’s sister question why no ECG was done at Dande Hospital, where the judge was taken around 4 am from his cottage at Ravi Bhavan government resthouse in the Civil Lines area.
    Records, however, show that an ECG was, indeed, done at Dande Hospital, a copy of which has been obtained by The Indian Express. Asked why the ECG report mentioned the date as November 30, Dande said, “Brijmohan Loya was brought to our hospital on December 1 between 4.45 am and 5 am. After an ECG was taken by the resident medical officer, he was advised to be taken to a higher hospital where necessary cardiac treatment was available. The date November 30 appearing on the ECG may have been due to a technical glitch arising out of a machine calibration issue.     That is the culture of rowdies and rougues .... Take Feku and Daku to Dharmasthala temple and make them to take oath, that they never involved in ANY criminal activities .... Later Karma will take care of them as it is taking care of Vajpayee, Advani etc .......

    Senior police officer's statement came from the place where the RSS headquarter located although Loya died there. Its a co-oincident. One can easily imagine what twist might have been occured with in this short span of period after the public press meet of three senior judges.
    On Dec.1, 2014 the late judge’s sister says in an interview to Caravan magazine (on record video) her brother was offered100 crores and a house in Mumbai. Now all of sudden why this has happened can be understood.

    Curiously, the ECG published by the Indian Express is time-stamped “05:11, November 30”, i.e. a day before Loya was taken to hospital. The newspaper does not explain the reason for the wrong date given the role ECGs play in helping doctors review a patient’s case history, it is unusual for the date to be off . The judge’s name is also spelt incorrectly on the ECG report.
    After the discrepancy attracted widespread criticism on social media, the Indian Express sought an explanation from the hospital about why the date of the ECG was wrong. This is what the hospital’s administrator said:
    “The date November 30 appearing on the ECG may have been due to a technical glitch arising out of a machine calibration issue. We recalibrate our machines every three months or so to prevent such glitches. But sometimes the glitch may occur in the intervening period. We stand by the fact that the ECG was taken at our hospital on December 1.”
    1. large variations in the precise time of his death
    2. the absence of any prior medical history suggesting the possibility of a heart attack
    3. why he was taken to hospital in an auto-rickshaw in the early hours of the day
    4. the mysterious signature on the post-mortem report by “maiyatacha chulatbhau”, or paternal cousin, when his family says there is no such person in the family,
    5. the wiping clean of all data from Loya’s phone before it was returned to the family
    6. the presence of blood on his clothes
    7. the role played by an “RSS activist” in telling Loya’s family about the location of his body, and delivering his phone, to the family
    The signature of the ‘paternal cousin’ on the post-mortem is another mystery. “I do not have any brother or paternal cousin brother in Nagpur,” Loya’s father told Caravan. “Who signed on the report is another unanswered question.” As is the deletion of data from Loya’s phone.
    Loya’s sister, Anuradha Biyani, a medical doctor based in Dhule, Maharashtra. She has studied Medicine & know how to read ECG.
