Gujarat Congress moves Supreme Court over EVM ‘tampering’


New Delhi, Dec 15 (Zee News): The Gujarat unit of the Congress party has moved the Supreme Court over its allegation of rigging of EVMs and VVPATs. The top court is slated to take up the matter for hearing later on Friday.

Veteran Congress leaders and senior lawyers Kapil Sibal and Abhishek Manu Singhvi are likely to argue for their party in the top court.

The Gujarat unit of the Congress party had raised concerns over allegations of EVM tampering but the Election Commission had rejected the charges.

There were complaints of Bluetooth devices being connected to EVMs. Senior Congress leader Arjun Modhwadia had complained that three EVMs were seen connected to Bluetooth devices and he sent the complaint to the ECI along with screenshots backing his complaint.

Responding to the allegations, the Election Commission had said they were looking into the complaints. A team of Election Commission visited a polling booth in Thakkar Plot in Porbandar to find out if there was some malfunctioning.

Modhvadia had said they detected EVMs at three polling booths at Memanwada are connected to external devices through Bluetooth. "When the bluetooth of a mobile phone is turned on, a device named 'ECO 105' is shown as available. This clearly means that the Electronic Voting Machines (EVMs) can be tampered with using the device via bluetooth," he alleged.

"The chips fitted in the EVMs appear to be programmable using bluetooth, and this raises the possibility of tampering. The voting system should be immune to such connectivity to external devices," he said.

The ruling BJP, however, had maintained that the allegations by Congress showed they were in "search for an excuse" as it knew that it would bite dust in the election.

"Members of the Congress are saying there is a defect in the EVMs. The EC would respond to it. But we can say that the Congress is searching for an excuse even before the results are out, as it stares at a loss in the elections. They are trying to hide behind the EVMs," BJP spokesperson Sambit Patra had said.

    After the UPA retained power in 2009, it was L.K. Advani who began questioning EVMs, pointing out their discontinuation in Germany and the US.
    In fact, Advani even wrote a foreward in psephologist and now party spokesperson G.V.L. Narasimha Rao’s book on EVMs, titled ‘Democracy at Risk! Can we trust our Electronic Voting Machines?’, published in 2010.
    In fact, it was on a PIL filed by BJP Rajya Sabha MP Subramanian Swamy that the Supreme Court, in October 2013, directed the Election Commission to introduce the VVPAT system in a phased manner. The idea was to implement it fully by 2019.
    The response ECI and two electronic voting machine (EVM) manufacturers – Electronics Corporation of India Limited and Bharat Electronics Limited – to an Right to Information (RTI) query relating to a petition filed following the Uttarakhand polls has revealed administrative and security protocol violations as several machines were apparently handled by unqualified staff.
    while the EC had in response to an RTI query stated on May 29 that 10,05,662 ballot units (BU) and 9,28,049 control units (CU) were manufactured by BEL under Ministry of Defence and 10,14,644 BUs and 9,34,031 CUs were manufactured by ECIL under the Department of Atomic Energy, the petitioner has stated that this figure does not tally with the information provided by ECIL.
    He said the ECIL has responded saying that it had manufactured 13,70,391 BUs and 11,31,399 CUs. So, in fact, it had manufactured 1,97,368 more units of CUs and 3,55,747 more units of BUs than those disclosed by the EC.
    ‘What is happening with the extra machines?’
    The RTI response from the EC has also established that in the past few years, EVMs have been stolen or robbed only in the states that are under BJP rule now – namely Gujarat, Madhya Pradesh, Chhattisgarh and Assam.The petition had charged that surprisingly, in all 70 cases in which EVMs were stolen or looted.
    Scrap the EVM and let's ballot box. Save democracy.

    Since VVPATS were used with EVM's paper trail would have been available and each voter gets confirmation to whom they voted. So it is most unlikely that a foul play can be done.

    Anybody can name their mobile Bluetooth ECO 105 and they might have seen that. EVM does not have any bluetooth or any wireless hardware. I wonder that senior leader even know what is bluetooth and how does it work. Anyway EVM still available. Let him show the hardware. We need educated leaders. not alu to sona converting machines

    Now with mission accomplished, it doesn't take a genius to remove the Blutooth connectivity and act innocent. VVPT ? Remaining 3 days are more than enough to take care of that too with the 'co operation' of the concerned. There's no other explanation for some candidates scoring 0 votes of late.
