Filmmakers, writers should be allowed freedom of speech and expression: SC


New Delhi, Nov 16 (IANS): Filmmakers and writers should be allowed to enjoy freedom of speech and expression and there can't be curbs put on this, the Supreme Court said on Thursday as it rejected a petition seeking to block the release of film 'An Insignificant Man' based on Delhi Chief Minister and AAP leader Arvind Kejriwal.

The film will be screened in cinema halls on Friday as scheduled, with the Supreme Court ruling.

Rejecting the plea by Nachiketa Walhakar seeking to restrain the release of the film, the bench of Chief Justice Dipak Misra, Justice A.M. Khanwilkar and Justice D.Y. Chandrachud said: "Courts should be extremely slow in passing restrain order" as there can't be curbs on the freedom of speech and expression.

Saying that filmmakers and writers should be allowed to enjoy freedom of speech and expression, the court said that all creative people have the right to enjoy their works in production of films and dramas.

Petitioner Walhakar had allegedly thrown ink on Kejriwal in 2013. He told the court that the video of that incident was being shown as part of promotion of the film.

    Indian movies from decades use to be popular among the audience without any controversies. The movie goers just use to take it as entertainment. Since PM Modi government elected to power in 2014 even the film certifying board after saffronisation embroiled in more controversies.

    Ever since Smriti Irani made Information and broadcasting ministry CBFC and IFFI is freedom of speech and expression is further curbed.
    It should be noted that her previous ministry as high-profile HRD Ministry from the day one remain in controversies despite her fake education background.
    Now Irani taking over the reins of ministry movies like 'Padmavati', 'Sexy durga' and every other movie which use entertain audience become controversial.
    This decision of Supreme Court is highly appreciable and need to be respected in all forms.

    But all these professionals must undergo periodic medical check up. It should be mandatory . Because as we grow old our body parts detiriorates ,including brain. To renew a driving licence ,eye check up are must. A panel operator ,in a process industry must under go eye test and stress test periodically. A pilot has to undergo many medical check ups. If a pilot a makes a fault only 380 people will die But if the supreme court mentioned professionals makes mistakes the impact will be disastrous ? Because thier nonsense reaches millions with short time ? They are not superhumanbeings or wizards.
