Bengaluru: 2-wheelers with less than 100cc engines not to have pillion seats


Bengaluru, Oct 22 (IE): The state government has decided to not allow two-wheelers below 100 cc to have pillion riders. It will impress on two-wheeler manufacturers not to attach a seat for pillion riders on motorcycles with engines with a capacity lower than 100cc if they want to sell their products in Karnataka.

A notification to this effect was issued by the Transport Department on October 16 in compliance of the Karnataka Motor Vehicle Rules, 1989. The rules say, “No pillion seat shall be attached to motorcycle with less than 100 cc engine”. The purpose behind it is to prevent pillion riders becoming easy victims of accidents.

However, the state used to issue ‘type approval’ certificates to the motor vehicle manufacturing companies allowing them to sell their two wheelers attached with pillion rider seat against the rules till now. But, this contradiction was pointed out by the Karnataka High Court recently while hearing a accident insurance case from Mysuru involving a minor. Taking note of it, the state government issued the notification and informed the court about it. The case is still pending, a source said.

Confirming the notification, Transport Commissioner B Dayananda said that it will be given effect prospectively and not retrospectively. Therefore, this notification has nothing to do with existing motor vehicles with 100cc engines. The state government is considering to amend rules to allow new motorcycles with engines below 100 cc, as there was a opinion among people that this notification will affect the middle class.

“Such restrictions hardly exist in other states. The number of two-wheelers with engines smaller that 100cc are less in number in the market. But the state is likely to take a call on the lines of other states,” a source in Transport Department said.

Transport Department Principal Secretary Dr B Basavaraju said the issue is being examined by the government and decision will be taken accordingly after the government takes a final call on it.

As of now, the Transport Department issues ‘type approval certificate’ to manufacturing companies ignoring the Rules 143(3), considering the certificates issued by the authorised vehicle certifying agencies like ARAI and CIRI for 1+1 to the two-wheelers attached pillion rider seat. Now, this can’t be done.

“We have decided not to issue ‘type approval certificates’ to manufacturers that intend to sell two-wheelers with pillion rider in below 100 cc vehicles,” an official said.

    Insted of making many types of rules on two wheeler vehicle.. Ban this unsafe vehicle as common transporter...
    But replace this with some safe vehicle (small 2door car, 4wheeler scorer type vehicle..) in same budget...

    100 cc bagya for two wheeler companies. Ridiculous laws from this govt at fag end of their rule.
    They are not giving badge license for drivers who have not passed 8th standard, but even if they are not passed first standard, they can become mlas & Ministers, then pass nonsense rules.

    This is how the country works Fekus, Daku's, Illiterates, Fire igniters, Thiefs can rule us and they have separate rules. But poor janta cannot live peacefully. Now people have to own private auto rickshaw's to take their family out and person who are dating specially younsters should be owning higher end two wheelers which will be a burden to the parents. Enjoy and safe driving.

    2 wheeler drivers should know that they will be at the receiving end mostly in case of accidents. They should be aware that they are unprotected. So they should always drive carefully. At the same time other users of the road (4 wheelers, 6 wheelers and so on) should know that the 2 wheelers also have equal rights in using the road but 2 wheelars are unprotected users. So they should learn to respect 2 wheeler riders and give them enough way. Government should know how important to have good quality roads!
    Otherwise all these measures are like holding crying baby's mouth.

    Three (or more) people are seen going in a bicycle without cc power but pedaling power. It's called poor man’s ‘Vahana’ Any restriction for double or triple riding?
    Accidents mostly take place with higher cc where people use thrust to perform stunts and riding with high speed (some times, show off in front of ladies colleges)

    Make it 105 CC problem solved. Manufacturers are expert in this .Previously there was less tax for vehicles below 100 CC and most of them were autogear so driving was easier. Because of small engine difficult to speed up compared to bigger vehicles,

    Corrupt Congress government is not worried about the bad condition of the roads but they are very much worried about how to collect the fines by using different types of crooked ideas.
    I call on public not to pay any fine for whatever reason.
    We have to make RTO officials frustated so that they convey the message to the state government.

    Scooters are more dangerous than the motor bikes since the former have smaller tire than the latter. It's always dangerous for women to sit sideways in scooters. It's difficult t maneuver pot-holes with scooter & with women sitting sideways. Also it's very dangerous for women to sit sideways in scooters with child in their lap or in between the riders

    How do pillion riders become easy victims of accidents in 2-wheeler less than 100cc?
    They are safer in less than 100cc rather than more than 200cc bikes!

    Because in case of emergency braking or sudden fall into path holes light weight bikes go off balance very easily..
    thats why many people prefer Royal Enfiled for better ride control and suspension.
