Aadhaar-bank account linking mandatory: RBI clarifies

New Delhi, Oct 21 (DHNS): The Reserve Bank of India (RBI) on Saturday came out with a clarification that the linking of Aadhaar numbers with bank accounts was mandatory in cases under the prevention of money-laundering rules.

The central bank's move followed reports that quoted a Right to Information Act (RTI) reply given by it that "so far it has not issued any instruction on linking the 12-digit biometric number with bank accounts by December 31."

Setting the record straight, a RBI release said: "The Reserve Bank clarifies that, in applicable cases, linkage of Aadhaar number to a bank account is mandatory under the Prevention of Money-laundering (Maintenance of Records) Second Amendment Rules, 2017, published in the Official Gazette on June 1, 2017."

These rules have statutory force and, as such, banks have to implement them without waiting for further instructions.

The government has made it mandatory to link bank accounts with Aadhaar before the deadline of December 31. Hence, bank accounts not linked to Aadhaar will cease to become operational.

In its fight against tax evasion, the government said it has made it mandatory to quote the Aadhaar number for opening bank accounts.

It had also made Aadhaar compulsory for 135 schemes (of 35 ministries) including free cooking gas (LPG) to poor women, kerosene and fertiliser subsidy, targeted public distribution system (PDS) and MGNREGA.

However, the Supreme Court restricted the use of Aadhaar to six schemes, where the government provides benefits or subsidy to individuals.

The RTI query before the RBI was filed by news website money life.in. The RTI query also asked if the central bank had the Supreme Court's permission for mandatory linking of bank accounts with Aadhaar.

The RBI, in its reply, said it has not filed any petition before the Supreme Court, which has said Aadhaar is not illegal and privacy is not absolute.

The RBI reply led to reports that made out that the government and the RBI were not the same page.

While banks have been threatening their account holders to furnish UIDAI-issued Aadhaar to experience seamless banking experience or face suspension of their accounts, RBI has made it clear that it has not issued instructions regarding mandatory linking of the two.

Saturday's clarification by the RBI was to stop confusion by news items, bank officials said.

The RTI query had asked the RBI to provide a copy issued by it for mandatory linking of Aadhaar number of their customers with their bank account.

The RBI's reply was: "The government has issued a Gazette Notification GSR 538(E) dated June 1, 2017, regarding Prevention of Money laundering (Maintenance of Records) Second Amendment Rules, 2017, inter-alia, making furnishing of Aadhaar (for those individuals who are eligible to be enrolled for Aadhaar) and PAN mandatory for opening a bank account. It may be noted that the Reserve Bank has not yet issued an instruction in this regard."

New Delhi, Oct 21 (BT) : It seems there is no end to the debate regarding Aadhaar linking. While banks have been threatening their accountholders to furnish UIDAI-issued Aadhaar to experience seamless banking experience or face suspension of their accounts, in new revelation, the Reserve Bank of India (RBI) has made it clear that it has not issued instructions regarding mandatory linking of the two. It made its stance clear in response to a Right to Information (RTI) application filed by news website moneylife.in.

When asked to provide a copy issued by it for mandatory linking of Aadhaar number of their customers with their bank account it stated "the Government has issued a Gazette Notification GSR 538(E) dated 1 June 2017 regarding Prevention of Money laundering (Maintenance of Records) Second Amendment Rules, 2017, inter-alia, making furnishing of Aadhaar (for those individuals who are eligible to be enrolled for Aadhaar) and permanent number (PAN) mandatory for opening a bank account. It may be noted that Reserve Bank has not yet issued an instruction in this regard.

It also revealed that it has not even filed any any petition with the Supreme Court on seeking explicit permission of linking the two. "RBI has not filed any petition with the Supreme Court," the RBI said in response to the query.

The replies clearly show that government and RBI are not on the same page. In its fight against tax evasion, the Centre has made it mandatory to quote the Aadhaar number for opening bank accounts and also made Aadhaar compulsory for 135 schemes (of 35 ministries) including free cooking gas (LPG) to poor women, kerosene and fertiliser subsidy, targeted public distribution system (PDS) and MGNREGA.

However, the Supreme Court has restricted usage of Aadhaar to six schemes where the government provides benefits or subsidy to individuals.

    Already aadhar issue is in court on right to privacy and is being taken up in November.
    Govt has to minimize these stipulation and rules.

    People are confused and have to spend lot of their valuable time in complying with these rules and stipulations.

    3. Voter ID
    4. Ration card
    5. So many other cards also like Senior Citizen Card, Driving License Card etc.

    People have to stand in ques, waste their time, some times bribe to get the cards. Red tapism does not stop. Why they cannot unify many information in one card and the concerned dept have access for only the info they require.

    when RBI says its compulsory to the public to link Adhar-bank account its also compulsory duty of the RBI to safe guard each individual money without any online fraud.

    even one citizen out of 100 crores population becomes victim of online fraud for been linked to adhar - bank account its RBI responsibility to refund the amount.

    when you say its compulsory its your duty to make sure its safe.

    ..first of all why so much hue & cry for AADHAR linking when MODI Govt streamlined otherwise a messed up AADHAR program..Congress just brought a toothless AADHAR which is no legal sanction, no statutory power, its just worthless a card spending crores of public money..MODI govt passed in parliament even after repeated obstacle from Congress, it faught with SC, easy to get registered, it streamlined process, now more than 90% adults registered...then what is the problem & who has problem!!..why fake news spreading!!

    Well if RBI has issued circular to all the banks it should provide copy of the same to the RTI activist who had asked for the same,
    if not then it certainly proves once again it is under pressure of center to toe its line against the present rulings of court which are relevant until it over rules the same.
    Now autonomy of many institutions are under threat & one by one they are becoming puppets on strings held by center.

    It was an East India Company created emblem. It is the emblem used on East India Company's 1835 gold mohurs.

    Despite claiming to be independent, we are still holding on to the East India Company!
