Bengaluru: High Court quashes election code violation case against DVS

Bengaluru, Oct 12: The state High Court, On Wednesday October 11, passed an order quashing the proceedings initiated in a subordinate court against union minster, D V Sadananda Gowda, relating to violation of election code of conduct.

The single judge bench of the high court presided over by Justice Aravind Kumar, which heard a writ petition filed by the minister seeking dismissal of the hearing going on in the case, passed an order as above. The case in question was filed in JMFC court Mangaluru.

Advocate for the petitioner, S Rajashekhar, contended that his client had never violated code of conduct as alleged. He pointed out that the complaint filed with the police and various sections of law mentioned by the police in the charge sheet do not match."The allegation was altogether different. But the police have unnecessarily added section 171 H of IPC in the charge sheet. This measure is against constitution. Therefore, the case deserves to be dismissed," he argued. The bench of the high court upheld his contention.

The special election officer had filed a complaint in Mangaluru rural police station, accusing Sadananda Gowda, who was engaged in campaigning for BJP candidate fielded in Dakshina Kannada constituency during Lok Sabha election held in 2014, of violating code of conduct on April 9 that year by participating in electioneering beyond the period permitted.

    I think Naveen should read again what Reshmi has written. She asked why there are no raids on top opposition politicians that means congress top leaders whether in Delhi or Karnataka. Ultimately Congress and BJP both are same when it comes to corruption. There is give and take relationship between Congress and BJP and people with stupid intelligence blindly support these parties without looking at the corrupt and criminal nature of these politicians. In India more than 95% of politicians are corrupt and criminal.

    When India is being ruled by rascals, what better can be expected. All systems under the influence of central government and central government using the same on opposition. I am not saying don't target opposition. Everyone should be equal in India and hence these authorities should be independent. BJP saying Sonia Gandhi is corrupt. Why not action initiated against her? What about Robert Vadra? Why BJP is silent on Vadra? Is it because he is associated with Adani? Why no investigation against corrupt in BJP? Why top politicians from opposition who are corrupt are not being raided??? In India, there are different laws for different people. It's not Congi vs BJP but it's good vs evil. All know the credentials of DVS/Eshwarappa/Yeddi/Shobha. But no one dare to take action against them as idiots still vote for them.
