NIA office in Bengaluru asked to investigate 'Love Jihad' in Kerala

Daijiworld Media Network - Bengaluru (SP)

Bengaluru, Aug 17: The Supreme Court which is looking into a case of alleged 'Love Jihad' in Kerala has said that it will deliver its verdict after National Investigation Agency (NIA) office at Bengaluru conducts complete probe into the said case, and also after taking into consideration statements of Kerala police and the opinion of the girl in question.

The Supreme Court bench which is hearing the case also said that retired judge, Justice R V Ravindran, will oversee the NIA investigation. It also clarified that it has chosen to get the investigation done through Bengaluru unit of NIA to ensure that the probe is held without being under any kind of pressure, it is transparent and judicious. The bench ordered Kerala police to extend full cooperation to the investigating team.

Additional solicitor general, Maninder Singh, who represented NIA in the Supreme Court, said that several marriages conducted on the model of Love Jihad in Kerala follow a particular trend. He argued that in most cases, Hindu girls who have some differences with parents are being targetted for separation from parents and then converting them into Islam. He had sought involvement of NIA in the probe to bring more details out.

Senior advocate, G Giri, who represented Kerala government, said that the state does not oppose NIA investigation into Love Jihad. He said that a special investigating team is already on the job, and that Kerala is not opposed to the involvement of NIA.

Although advocate for the petitioner, Shafeen Jahan, Kapil Sibal, asked the bench to hear the girl's version first, the bench said it would hear the girl after the probe is complted, Kerala police report is examined, and statements of others concerned with case are recorded.

In November 2009, DGP Jacob Punnoose stated there was no organisation whose members lured girls by feigning love with the intention of converting. He told the Kerala High Court that 3 out of 18 reports he received expressed some doubts about the tendency. In December 2009, Justice K.T. Sankaran of Kerala High Court found indications of forceful conversions. He stated that from police reports it was clear there was a "concerted effort" to convert women with "blessings of some outfits". The Karnataka government stated in 2010 that although a large number of women had converted to Islam, there was no organized attempt to convince them to do so. In 2012, after two years of investigation against a website into their allegations of love jihad, Kerala Police declared it as a "campaign with no substance". Subsequently, case was initiated against the website. The police said they found fake posters of Muslim organisations offering money to Muslim youths for luring and trapping women. Uttar Pradesh Police in September 2014 found no evidence of attempted or forced conversion in five of six reported cases" of love jihad reported to them in past three months. Police said sporadic cases of trickery by unscrupulous men are not evidence of a broader conspiracy.
More than 22m cases are currently pending in India’s district courts. Six million of those have lasted longer than five years. Another 4.5m are waiting to be heard in the high courts and more than 60,000 in the supreme court, according to the most recently available government data. These figures are increasing according to the decennial reports.
In April, the Chief Justice TS Thakur broke down at a seminar attended by the PM, reporting the stress on courts that are unable to hear or decide cases because of a shortage of judges.
Do Supreme Court of India has surplus free time for 'love jihad' to investigate when millions of cases pending in courts? Why SC hearing on 'love jihad' which is not written anywhere constitution?

This is how are Supreme Court is being dragged into unwanted issues. Political parties and Politicians made use of the CBI in the past to settle scores and n the bargain detroyed the credibility and morale of the local police. With the increasing use of NIA, CBI will become a defunct agency.

when advocate for the petitioner, Shafeen Jahan, & congi Kapil Sibal argued against Govt saying Girl is matured and 25 year old, then honorable SC said 'Have you heard about the game Blue Whale Challenge? You can lead people anywhere after psychologically influencing them," "You are right. She is a 25-year-old girl. But why does she give three names at different times before the HC? Why does a professionally qualified homoeopath leave her profession all of a sudden?"..cant hide truth, it will come up for good..

Conversion should be declared as illegal in our constitution and if any children born to the couple should go with the religion of their mother. Any properties or any sort of wealth of anchesters and parents should go to their children name automatically by law. I think this would be a historic judgement if supreme court brings forth this law. All the problems relating to convesion would stop in india.

I don't think nation should spend money on such bad things.
    Everyone deserve good life.
Forceful converting should be banned. Can not ban inter religious marriage.
But Hindu girl should be made aware of Muslim personal laws that govern them before falling in love or should undergo certain kind of test n get certified.
A new entrance exam for families should be held if they are fit for marriage or family, can they drive the life smoothly

Good decision by Supreme court. NIA is appointed as supreme court feels it is a serious case and even Kerala High court nullified the marriage. May be useless Sibbal failed to convince SC and not argued as N.M Nawaz.

Yes there are many happily married inter cast marriage. NIA is not investigating all inter cast marriage. Where there is a compliant by girl or parents and where the people are converted to send them to Syria NIA investigation required.

The term "Love Jihaad" is fabricated by the enemies of Muslims. They just want to project every couple from different community who fall in love and get married are on a mission of "Love Jihaad".
We have thousands of inter-religious marriages who are leading happily married lives.
