SC refuses to take cognisance of UP hospital tragedy


New Delhi, Aug 14 (PTI): The Supreme Court today refused to take cognisance of the recent deaths of children at a government hospital at Gorakhpur in Uttar Pradesh.

The bench comprising Chief Justice J S Khehar and Justice D Y Chandrachud asked the lawyer, who mentioned the issue before it, to approach the Allahabad High Court with his grievances.

The lawyer has also sought an SIT probe into the deaths of children at the Baba Raghav Das Medical College (BRD) hospital in Gorakhpur.

The court observed that the authorities were handling the situation and the grievances, if any, have to be raised before the high court concerned.

Over 60 children have reportedly died at BRD Medical College Hospital since August 7, many for want of oxygen whose supply was disrupted after bills were not paid to the vendor.

At least 30 children were reported dead in the last two days alone. Many of the victims were infants who perished in the neo-natal intensive care unit.

Police had said no case has been registered so far in the absence of a formal complaint.

The state government had on August 12 ordered an official inquiry by the chief secretary and suspended the principal of the Medical College Hospital Rajiv Mishra.

    The 2017 Goa elections saw a close contest for most seats. At the end, the Congress with NCP had 18 seats and was the single largest party, needing only three more for a majority. The BJP had 13, (well short of a majority), with the remaining ten seats in the 40-member assembly going to other parties and independents. Yet, the governor appointed a BJP coalition with the MGP (three seats), Goa Forward Party (three seats) and three independents.

    Fali Nariman and several newspaper editorials lambasted Goa governor Mridula Sinha for not calling the single largest party with a near decisive MLA tally. The matter went to the Supreme Court before Chief Justice Khehar. What he is reported to have said is astounding by any standard.

    “Where are your numbers? You could have finished the case in 30 seconds by showing they [BJP] don’t have the numbers. It seems you were not confident about the support you have. You should have asked the governor what nonsense she is doing and confidently said look we have the numbers. You should have sat on a dharna. You did nothing. …You had the entire night [ever since moving the SC], the best time, to get affidavits ready or present your supporters before us…. You are putting us in the position of the governor. These things you should have stated before the governor,” he asked.
    The chief justice advised the Congress to hold a dharna before the governor instead of approaching the court. Chief Justice Khehar asked for an assembly test but should not have spoken as he did. It was politician talk.
    When Supreme Court outlawed seeking votes in the name of religion, caste, race, community or language, a potentially far-reaching verdict ahead of assembly elections in five states where faith and caste have traditionally driven voting.The dissenting judgment was delivered by Justices DY Chandrachud who opposed the motion.
    Now one can understand the loyalty of these judges to the party and in this case refusing to take cognisance.

    SC is being asked to meddle in matters which is being investigated by the administrative authorities. As the SC has correctly pointed out, let the investigation first proceed and if there are criminal issues and are not being addressed, then only involve the courts. Don't ump the gun.

    Dear Henry Misqith,
    Allegations are emerging that the DR Kafeel khan ran a parallel clinic and oxygen were stolen to his private clinic. the news did not come from Social platform like FB but report fom India today. in the net. wether or not it is true will come to be known after a thorough investigation. Let us wait for reports from a magisterial enquiry. So let us not pass premature comments and wait for some time so that our comments does not fall flat on our face.

    Innocent children have already perished due to human carelessness and negligence.
    Proper investigation should be carried out and punished appropriately and no political upper hand should be allowed to play dirty game. No one is above the law of the land. Justice should prevail. If such incident had taken place in Karnataka, Amith Sha would have bombarded with his verbal attack and PM would have supported with extra combustion.

    Instead of writing political messages, we need to find solution for future.
    Suppose some hospital doesn't have funds to buy fuel for generator tomorrow, then what will they do?
    HOD or MD need to go to nearest nationalized banks and raise the loan.
    Government can pay that loan and interest at their convenience.

    An old man recently went to collect his pension after six months with a certificate that he is alive, in Pune. Clerk gave him the recent 3 month's pension and not the earlier, although he knows he was alive, he said the Audit will object that it was paid without proof. This is Govt hospital and not pvt. Who has given authority to MD to mortgage the hospital for loan ? Has the govt given him authority to take loan ? Even the amount sanctioned by govt, there are procedures if one goes out of it, the Audit will put them in trouble. I myself had a problem with nationalised bank, but when thy said they are helpless due to Audit, I had to keep quiet.

    Innocent Dr. Khan is sacked because he is a Muslim and a soft Prey to Make a Scapegoat. Supreme Court needs to take suo Moto note of this sad tragedy and under its own supervision order enquiry otherwise it will be another forgotten case.
