Udupi: Elderly lady harassed by sons over property, human rights body urges public support

Udupi, Jul 27: President of Udupi Human Rights Protection Foundation Dr Ravindranath Shanbhag on Thursday July 27 brought to public attention the case of an elderly lady who is facing harassment at the hands of her son over property issue and urged the public to join hands in helping protect the rights of senior citizens.

Addressing a press meet here, Dr Shanbhag narrated the ordeal of Sulochana Pai from Kadtala village here, who, he said, is in need of support from people of her village in order to get justice, even though the deputy commissioner has given order in her favour and the authorities are willing to implement that order.

Sulochana Pai toiled as a chef and strived to bring up her two sons, Ramakanth Pai and Bharath Pai. She spent her hard earned money to build a house on the 5 cents land granted by the government. She also fulfilled all her responsibilities as a parent by marrying off her two sons.

"The death of her husband Janardhan Pai in 2012 left her desolate. Both her sons had yielded to alcoholism. They were earning sufficiently as lorry drivers, but instead of taking care of their mother, they began to pester her for money. When she refused to give any money, they drove her out of the house. In spite of the house being in her name, the elder son does not allow her to dwell there. There is no sign of her second son Bharath, who occasionally turns up only to extort money from her," he said.

"Sulochana took shelter at the house of her relative Ramesh Nayak for survival. Bharath followed her even there to harass her for money. But Sulochana was again forsaken on the demise of Ramesh Nayak.

"In 2016, she complained to the police officers and the matter was looked into. The elder son Ramakanth agreed to give up the house to her, but did not do so. In March 2016, she gave a complaint to the Senior Citizens’ Tribunal with the help of Human Rights Protection Foundation, Udupi.

"After eight months of hearing the matter, the Tribunal ordered Ramakanth to provide maintenance of Rs 6,000 per month. He neither appeared for the hearing nor did he pay any money. But since there was no clear order for the possession of house, Sulochana Pai had to appeal to the Udupi deputy commissioner. Now the tahsildar of Karkala has been ordered to give Sulochana the possession of the house. Sulochana who was seriously ill since 4 months has recovered under the shelter of the Organisation. She has also been operated for cataract. She now yearns to dwell in her own house," Dr Shanbhag said.

"Presently the son has refused to leave the house under any circumstances. The organization has contacted the tahsildar of Karkala to give Sulochana the possession of her house and requested him to provide protection to her.
However, law and order or government departments alone cannot provide justice. It is only with the full-fledged support of the citizens that the senior citizens may live in peace.

"Law and order would fail in the protection of senior citizens unless the public joins hands with the government officials for the same," he urged.

He also said that his Foundation presently has 230 cases of elderly being harassed by their children, and that the deputy commissioner has appointed him to resolve such issues in Udupi and Chikkamagaluru.

Speaking to media persons, Sulochana, with tears in her eyes, said that she does not want to live with her sons in the same house as they constantly get drunk and harass her. She said that she would rather prefer to live in an old age home, where she is presently staying.

    This is total Disgusting. Look at her plight and see how tired she is of life. She has already served her sons and family well. What more does any sic sibling want from this poor lady?
    What do old people like her do? Young people are strong.
    Why cannot our Government help her? Where are all the people who claim they like to help the poor and distraught? Where is everyone?
    So long she is suffering. Nice to know so many are here like me leaving our comments. Daijiworld - Please publish this news daily until the Government bends and comes to her rescue.
    At least she can spend her old age in peace. Jesus bless her.

    Now where are all those shout for when religious people help poor ,say converters,and make lot of noice.why cant they step forwards and help their own community when a old lady is crying for need and help when her sons put her out of her own house?

    It is very sad to read about the plight of this senior citizen at the hands of her wayward sons. It is more pitiable that no one from her own community have given her a helping hand .The look in her eyes speaks volumes of the mental and physical torture she must have gone through. Unlike the west where the Social services or the police are informed through the emergency services ,even by a concerned neighbour ,our country is lacking and is way behind in providing succor to these helpless senior citizens. How many of these helpless seniors ,must be suffering in silence God alone knows. My sincere request to the Women and Child Welfare ministry is to have a helpline and more old age homes to help them .Kudos to Dr.Ravindranath Shanbhag for coming to her aid.

No matter you belong to any religion!but all religion says to respect and honour parents if you want to flourish and peace on earth. If you want to live long honour your parents. In olden days people lived long. Now we see people dying very early bcoz they don't have time to spend with their parents!!Lord Jesus himself recalled the force of this "commandment of God. Ephesians 6:2 says: "Children, obey your parents in the Lord, for this is right. 'Honor your father and mother,' (This is the first commandment with a promise.) 'that it may be well with you and that you may live long on the earth."' Tobit 4:3-4 says, “honor your mother and do not abandon her all the days of her life. Do whatever pleases her, and do not grieve her in anything. Remember her, my son, because she faced many dangers for you while you were in her womb.”
    “If you want blessings and grace from God and a good life, you have to love and respect your parents. If this love and respect towards your parents are missing, then all blocks, bondages, troubles, sickness and sorrows will come into your lives,” he said.

    Their sons neither helped their mother to live a dignified life and now nor they allow her to die peacefully. Locals & religious leaders should have some means to sort out these kind of issues.
    Drunkards, whoever it is, do not understand the pain of their wife, children and parents. They just want money to get drunk.

    I have high regards for Dr Ravindranath Shanbhag who works day and night to sort out similar issues irrespective of religion and cast. God bless you sir.

    I am also a senior citizen ..... My sincere suggestion to all the parents..... If you have property or any valuable things and if your children not looking after you..... please don't wait , please sell your things and put that money in Bank and with the interest stay in good old age home. At present situation most of the children are selfish and they are thinking of their gain only.

    Unlike western countries, majority of children in India, take care of their parents. I have visited hospitals, orphanages, old age homes and leprosy homes and found that except for a few run by religious, most of them are just horrible. Religious institutions do not accept people with children or having means. I feel, if possible, senior citizen housing is better. where you re your own king.

    Karnataka is better than some other places..... I have seen a documentary that in Madurai own children will kill their parents when they are old. When some reporter asked the villagers about this system...... They are telling that it is 300 years old system we are following that the elders are useless than we follow this system.

    I have seen this office, how they deal with our complaints, do they have any respect of higher authorities etc?
    So if there is any government is running in Karnataka please get the report of this taluk office , how many files are pending and why they are not resolved...

    The need of the hour is more old age homes. The old age homes have had to come up to cater to the needs of the elderly.
    Children do not take the elders as their duty but as useless appendages - burden in the family.
    Also,this attitude of the children has also largely contributed to the removal of elders from families. With this backdrop, the necessity for old age homes was felt, and is being increasingly felt with the passage of time. The entire spectrum of circumstances has led to this unhappy need for old age homes.
    It is very clear to all who visit an old age home that, all the inmates are there, not for the love of being away from home and independent but, because there is no better alternative left for them, once they are neglected and unwanted in their homes by their own children.
    The religious groups,temples,churches and mosques who are financially strong should view this as a serious issue and construct more old age homes. Everyone has to go through this (old age )phase and people should leave certain percentage of their assets and savings for the running of the old age homes. This way, you can make a difference.     Many elderly parents, especially those over 75, are treated like this old lady and it is not only very very sad but disgusting behaviour of the two sons. They are just waiting for her to kick the bucket and then sell the house and waste all the money on alcohol. The sons are liable under the Indian Penal Code to support their elderly parents and they are committing a crime for failing to do so. Hope the police will book them under the relevant sections of the IPC.

    why should these grownup men harass their mother.First they should pay her ,lookafter her.Not otherway round.As a senior citizen she has the full right to do what she wants.At present when police,govt.fail to give her rights,better she should sell it and live in home for the aged.because in her own house sons dont allow to live ,either peacefully.so with her money let her live there.The sons can look for a alternative.They are not children.why depend on mothers money,and harass too?

    Quite right. In addition recourse can be had to the Maintenance and Welfare of Parents and Senior Citizens Act, 2007 which provides a speedy remedy to elderly parents and senior citizens without own means, to claim maintenance fromtheir children. The Act creates an obligation. The Criminal Procedure Code 1973, section 125(1) can also be used by the magistrate to order the children to provide maintenance.
