New Delhi: SC stays Karnataka HC order granting relief to Janardhana Reddy


New Delhi, Jul 25 (DHNS): The Supreme Court on Monday stayed the Karnataka High Court order setting aside the Enforcement Directorate proceedings against former minister and mining baron Gali Janardhana Reddy and his wife Lakshmi Aruna and others, including provisional attachment of their assets worth over Rs 900 crore under the Prevention of Money Laundering Act.

“We are worried about it (impact of the judgement),” a bench of Justices R F Nariman and Sanjay Kishan Kaul observed, after Attorney General K K Venugopal submitted that the high court’s March 13 order would have huge repercussions in other cases.

“The high court order would not operate,” the court directed. Senior advocate Mukul Rohatgi, representing Reddy and others, contended that the properties cannot be attached under the Prevention of Money Laundering Act, while applying the law retrospectively.

“All the transactions took place prior to 2009 and money was routed through banks. My case cannot be resuscitated by applying the anti-laundering law,” he said.

The court, however, stayed the high court’s order and allowed the Enforcement Directorate, also represented by senior advocate Ajeet Kumar Sinha, to file a rejoinder affidavit within four weeks.

    These man of powerful political backing tactically supported BJP in Karnataka and at the same time Congress in Andhra Pradesh during former CM Reddy who died in helicopter crash.
    After the opulent wedding of his daughter post demonetisation, G Janardhan Reddy is at the centre of a fresh row, with the car driver of a state official allegedly committing suicide, leaving a note claiming he got Rs 100 crore converted into white money for the mining baron for the marriage.
    So one can understand how well the illegal wealth can influence the ruling parties which Bellary Reddy's disrobed from Karnataka to influence the justice system.
    Senior advocate Mukul Rohatgi, representing Reddy and others,who doesn't wanted extention of Attorney General post on government payroll know how wealthy are Reddy's citadel.
    Only in new India Justice is only applicable to poor.

    What a shame! People who have looted the country will be emboldened to do even more as there is no way that our law can punish them if it is flouted like this. Powerful prisoners will convert the jail into their luxury home and carry on their daily looting business with impunity. Our law is just a toothless element, with such corrupt judiciary and jail officers. Unless the whole loot with heavy fine is recovered, nobody will be scared from doing it again. Best example is Lallu Prasad Yadav. He looted the country by diverting tens of thousands of Crores of rupees under fodder scam case, yet he has only been barred from contesting elections, which he is contesting now through proxy. My suggestion is even the corrupt jail officials including the IG should be punished and the bribe amount should be recovered and added to government treasury and also they should be retired immediately without giving retirement benefits for bringing disrepute to the law & justice system. Political prisoners are never scared of the law. They enjoy everywhere, both inside and outside the jails. It is only for weak common man.
