CBI raids residence of NDTV co-founder Prannoy Roy, sparks outrage

New Delhi, Jun 5 (IANS): In a move that sparked outrage and which NDTV said was "a blatant political attack on the freedom of the press", the CBI on Monday conducted searches at the houses of the news network's co-founder Prannoy Roy for allegedly causing financial losses to a private bank.

The Central Bureau of Investigation (CBI) registered a case against Roy, his wife Radhika, a private company and conducted searches at his south Delhi residence in Greater Kailash-I and his house in Dehradun for "loss of Rs 48 crore to ICICI Bank", officials said.

The officials said the office of RRPR Holding, the promoter of the listed broadcaster, was also searched.

"Searches were conducted (on Monday) at four places, including Delhi and Dehradun," CBI spokesperson R.K. Gaur told IANS.

An FIR dated June 2 said the case has been registered against Roy, a veteran journalist, Radhika, NDTV and RRPR for "criminal conspiracy, cheating and criminal misconduct".

It relates to alleged irregularities in a 2008 loan of Rs 366 crore that NDTV took from the private bank on guarantee by the holding company.

The loan, according to the CBI complaint, was settled a year later for a repayment that was Rs 48 crore less than the loaned amount.

NDTV and its linked companies have been under the scanner since 2014 and were last year served notices by the Income Tax department and the Enforcement Directorate.

But, it was for the first time that the CBI has come into the picture of a financial probe against the network, often seen by Bharatiya Janata Party supporters as opposed to the party ideology and the government.

The news network in a strongly-worded statement said the CBI had "stepped up the concerted harassment of NDTV and its promoters based on the same old endless false accusations".

"NDTV and its promoters will fight tirelessly against this witch-hunt by multiple agencies. We will not succumb to these attempts to blatantly undermine democracy and free speech in India," the statement said.

"It is clearly the independence and fearlessness of NDTV's team that the ruling party's politicians cannot stomach. No matter how much the politicians attack us - We will not give up the fight for freedom and the independence of media in India."

But Information and Broadcasting Minister M. Venkaiah Naidu rubbished the witch-hunt allegation.

"Law is taking its own course. This government does not believe in interfering. If somebody does something wrong simply because they belong to the media, you cannot expect the government to keep quiet."

The CBI raids come days after NDTV anchor Nidhi Razdan had an on-air verbal tiff with BJP spokesperson Sambit Patra, after he alleged that the news network was following an "agenda", during a debate over the new central notification on cattle trade and slaughter. The BJP leader was told to leave the programme.

The CBI move triggered sharp reactions from some journalists, politicians and commentators.

Congress leader and former Information and Broadcasting Minister Manish Tewari said the raids were a "direct assault" on the freedom of the press.

West Bengal Chief Minister Mamata Banerjee termed the raids as a "disturbing trend" and her Delhi counterpart Arvind Kejriwal said it was an attempt to "silence independent and anti-establishment voices".

Former Uttar Pradesh Chief Minister and Samajwadi Party leader Akhilesh Yadav retweeted Banerjee and other tweets condemning the CBI raids.

Sudheendra Kulkarni, Chairman of the Observer Research Foundation who was earlier associated with the BJP and was close to L.K. Advani, said: "Raid on Prannoy Roy has less to do with financial wrongdoing, more with the 'wrong' of NDTV being an independent media voice. I condemn it."

Historian Ramachandra Guha, who writes for various national and international periodicals, tweeted: "The UPA regime was defined by cronyism and corruption; this BJP government...is consumed by the desire to punish its critics and rivals."

N. Ram, a veteran journalist and publisher of The Hindu and its former editor, said: "Those who value media freedom must speak out and act (be)cause they know that while nothing will happen in the end, the process is the punishment"

Shekhar Gupta, also a veteran mediaman, said: "CBI FIR for 48 cr 'loss' to private bank. Remember that line: name the man comrade, I'll give you the charge?"

    After the Roys had bought 7.73 per cent of NDTV shares from General Atlantic in December 2007, it led to an open offer to other minority shareholders. To fund the purchase of shares that the minority shareholders wanted to sell, the Roys created a company, named RRPR Holdings Private Limited after Radhika and Prannoy Roy. RRPR borrowed Rs 501 crore from India Bulls. With the shares of RRPR Holdings and their individual shares, the three promoters controlled the majority of NDTV’s equity.
    To cover part of the India Bulls loan, RRPR then borrowed Rs 375 crore from ICICI Bank. The private bank gave RRPR Rs 375 crore in October 2008, as per the deed of hypothecation. But by August 2009, RRPR had found another lender, a company named Vishvapradhan Commercial Private Limited, to repay the ICICI loan.When it gave the loan to RRPR, VCPR was owned by subsidiaries of Reliance Industries, and the money too had been piped from Reliance Industries to RRPR through VCPL. But in 2011-12, the Reliance company that had given VCPL Rs 403.85 crore — Shinano Retail, a step-down subsidiary of Reliance that also owned half of VCPL’s equity — claimed in its annual report that it had been repaid the entire amount.
    Part of this money had come from Eminent Networks, a company linked to Mahendra Nahata who is a board member of Reliance Jio. Eminent’s balance sheet for that year shows that it had given VCPL Rs 50 crore, and got rights over the Rs 403.85 crore worth of debentures of RRPR, which could be converted into 99.99 per cent of its equity. During the same financial year, VCPL’s ownership also moved hands to companies that are linked to Nahata.
    Who had repaid Shinano the remaining Rs 353.85 crore is not immediately clear. Filings with the Registrar of Companies do not shed any light on who plugged this massive gap. As of March 31, 2016, VCPL is still owed Rs 403.85 crore by RRPR and can convert it into equity to control over 29 per cent of NDTV’s shares.

    One year ago, while CM Siddhu's car moving on Bangalore road, his convoy (escort), stopped traffic for some time. TimesNow carried out hours long debate (lead by Arnob) with the title “VIP culture by Karnataka CM” & slammed Siddhu left and right for stopping traffic which included an ambulance!

    Its OK… it is objectionable to stop an ambulance, no matter by CM or PM. Let us also appreciate TimesNow’s so called 'concern' (even though such incidents do happen with almost any party leaders, including BJP). But, TimesNow did not stop there… even today, they dig same incident and show the clip and scream, “VIP culture”, “VIP culture”, “VIP culture”…

    Let us accept this also…

    Now, let us move further…. Last week, while CM Siddhu's car moving on Bangalore road, his convoy (escort) noticed an ambulance passing by. They stopped entire convoy this time and allowed Ambulance to go & then Siddhu's car moved. I was expecting TimesNow to report this news, at least in one sentence. But, no FekuBhakth channels reported this news!

    BJP and Modi Govt clearly knows, if the media is given any chance to speak the truth, it can and will be able to expose the Govt., overnight. They want to retain the feel good factor for the people.

    Can a corruption free govt., allow Mallya to run away? No it won't. Can Adani still be a businessman? No, he owes 100times more than Mallya to banks. Can Reddy Brothers would plan their come back in politics, a definite NO. In other words, is the overall level of corruption and black money reduced, not at all. Modi Govt., actually helped black money holders to convert it as white.

    NDTV is the only one national channel, which had some guts to come out with some stories of dis-comfort to Modi Govt. They backed it with some element of facts and ground realities. They were one off stories, to keep some element of credibility in comparison to many others.

    It is targeted for this reason and targeted to ensure no other channel dares to expose Modi Govt.
    India suffered the most not because of politicians but because of corrupt judiciary and police, that takes ages to settle cases. India is going through a second phase of self destruction, with a doctored media. It is the next generation, that is going to suffer the worse.

    ..what about ICIC bank loan fraud..whats journalism do with that..this is not only the case..Delhi high court allowed I-T department to proceed against NDTV in a case for receiving funds from a foreign funding institution and settling the account 80 % less than the original amount..there is also investigation on funds NDTV promoters received from foreign entities in connection with Aircel-Maxis case and that of purchase of planes by Air India..still you think its witch hunt!!..can they hide under Freedom of press by doing all these financial irregularies!!

    NDTV should have been shut down long back owing to operational losses. However, it is kept alive through money laundered through tax havens and I won't be surprised if it is indirectly owned by richest and corrupt businessmen of India. These businessmen use media as an instrument to get their work done in the political establishment. It is not that India is unique on this front. It is true with all democracies including USA where business interests use media to swing public opinion and wield political clout. Raiding NDTV is one of the way unfavourable establishment striking back. This will not be end of anything and thieves on either side will continue doing business as usual. Unsuspecting public are the greatest suckers in all this mess.

    At one end we have corrupt politicians in the BJP like Jaitley, Gadkari, Vasundara Raje, Shivraj Singh Chauhan etc etc has ministers but they are safe. Govt is Targeting only Corrupt Congress leaders like Chidambaram.
