Govt will have to step in if Muslims fail to change triple talaq practice: Naidu


Amaravati, May 20 (PTI): The government may have to step in and enact a law to ban triple talaq if the Muslim community fails to "change" the practice, Union minister M Venkaiah Naidu said on Saturday.

"It is for the society to take up the issue and it will be good if the (Muslim) society itself changed the practice. Otherwise, a situation may arise where the government will have to bring in a legislation (banning triple talaq)," Naidu said while addressing a meeting in Amaravati.

"This is not to interfere in anybody's personal matters, but at the same time it's a question of justice to women. All women should have equal rights. Equality before law...that's the issue," the Union Information and Broadcasting Minister said.

He recalled that laws were enacted to rid certain evil practices even in the Hindu society, like child marriage, sati and dowry.

"The Hindu society discussed child marriages and Parliament passed a legislation banning it. Second is sati sahagaman, an ancient practice, wherein a woman too ended her life following her husband's death. Now it is prohibited by law, by the Hindu society itself. Third is dowry. The Dowry

Prohibition Act was passed and the Hindu society accepted it," the Union Minister pointed out.

"When it felt that such practices were against the society's good, the Hindu society discussed them and brought in reforms. Some more reforms are also needed and efforts should be made in that direction," he added.

"See humans as humans and don't separate them as Hindus, Christians or Muslims. No injustice should be done to women by such discrimination," Venkaiah maintained.

The minister was felicitated by several associations and well-wishers upon his recent election as chairman of the governing council of UN-Habitat.

"I feel happy whenever the world recognises India. Take the case of Kulbhushan Jadhav. For the first time in history, India went to the International Court of Justice and obtained a stay against Pakistan's foolish act of trying to execute Jadhav. This is something we all should feel happy about," Venkaiah noted.

Recalling his long political career, Venkaiah said the "only desire" left in him was to see Narendra Modi as the Prime Minister for ten years.

"Mood of the nation is to go with Modi. If he is Prime Minister for a full ten years, India will emerge more stronger in the world," he said.

    Prove to me that Dowry menace is not there in Indian Muslims. On the contrary, the system is abused to such an extent that it is reversed than that is in practice in Arab custom.

    In Arabs, a man has to give dowry to the father of the bride with whom he is entering into contract to marry the daughter. The father demands a sum as per his status, so that just in case the daughter returns home over some dispute/divorce, she won't be a burden on her brothers/his sons. He builds adequate house for her stay after marriage or invests the dowry amount so that she is financially not dependable.

    Indian Muslims have abused the custom such an extent that the female has to give dowry (because in India it functions that way) but for TT, no ! Its Islamic ! Stupidity at its highest ! Arabs don't have TT ! Shame on you all who abuse your own laws and make women scapegoats !

    Patna: A woman in Bihar divorced her husband by uttering the word ‘talaq’ three times over the phone on Friday after falling in love with her brother-in-law.

    The woman served the instant divorce in the presence of a village court which had been convened to look into the matter, at Rajajan village, Khagaria district, some 170km east of Patna.

    The case comes amid a raging debate in India over the continuation of the Islamic practice of ‘triple talaq’.
    The woman, Rozida Khatoon, was unhappy with her husband Mohammad Junail and the couple were living apart for extended periods of time owing to Junail’s efforts to earn a livelihood.

    In his absence, Khatoon drew close to her brother-in-law, Mohammad Nasir, and the two fell in love.
    As news of their affair reached the ears of local villagers, they reported the matter to the local village court, which met Friday to decide their fate.

    At the court, Khatoon called Junail and divorced him instantly after uttering the word ‘talaq’ three times.
    She stunned the court by announcing her intention to stay with Nasir, a father of four children. “I love him [Nasir] and want to stay with him,” Khatoon told the court.
    When asked to present his position, Nasir agreed to accept Khatoon as his wife and declared that he would ensure the peace between both his wives.

    The court allowed them to stay together but informed Nasir that he would be held responsible in the event of any dispute between his wives.

    The incident comes barely three days after the All-India Muslim Personal Law Board reportedly told the Supreme Court that the women too can give talaq.

    Did the court took the opinion of the first wife? The court warned the man, that he would be held responsible if there are fights/disputes later on .... WHAT prevented the court to ask the opinion of the first wife ( elder sister ) before CONCLUDING ... All chaddi dramas

    The government has to respect the constitutional right to freedom of religion before introducing a law, and must make a reference to the Supreme Court for an opinion before introducing a bill. Naidu must realize that law and practice are not the same; no law can totally abolish an age-old custom. Sati, the example mentioned by Naidu was abolished by the colonial government during the time of the East India Company by Lord Bentinck (G-G)'s government, but still there are cases of widows willingly jumping in the funeral pyre or being forced to do so by the community.

    As for Dowry Abolition Act, the practice has not stopped; more due to parents of a girl of marriageable age trying to find a "suitable" groom - dowry is the opposite of dower; by paying dowry, the girl "buys" her mate; it is the other way round for dower.

    I am not condoning the triple talaq by any means, but the government should walk gingerly and not raise the ire of the vast majority of Muslims, and as well, be mindful of the backlash in the next election. Abolition of triple talaq doe not save marriages; it may lead to atrocities within the family, and there are other ways of ending marriage, as people have found when living together is hell. Read all the news about dowry harassment and murder/suicides despite the law which comes into play after the deed is done.

    I absolutely agree with your reasoning. A divorce will take place no matter what because there appeared a crack in the relationship - unless of-course if the couple puts behind their difference because of their children.

    The topic of TT is much in discussion because of the abrupt end it brings to the marriage by a man, giving no opportunity for the woman to explain her side. Whereas a marriage contract takes place after various discussions between the groom and the bride's father. The effort therefore is, to give similar discussion to divorce too, without ending a marriage by uttering the word thrice. It is especially because only a man can utter TT, while a woman has to go through 'Khula' a long process of explaining her reasoning before a panel. If Khula can be so long, divorce by man too should be long, not abrupt !

    Had the Indian Muslims been concern ed about their womenfolk as all neighbor countries did, the matter would not have ended in the courts today. Now that the courts are handling it, the community must go through the drudgery to prove why/how they are right which is impossible. At this juncture they cannot say its a religious matter because its affecting Indian society. When we Indian can do away Sati, child marriage, so will we do away with TT because its one-sided advantage-male !

    A divorce rate, whether more or less, is not a matter to be proud of. A society needs to be happy and should live in harmony with all members of different communities. To an outer look, we all should represent as INDIANS, not as representatives of our religion.

    Do not compare the 'divorce ratio' with 'a need to continue TT', rather strive to abolish TT so that a divorce will be difficult so the man will backtrack from it than going for it since its easy.

    You too are responsible for the separation and hatred between your community and others within India. Just look around, may it be Farsis, Jains, Budhdhists or Christians - though their method of worship deviates from the mainstream Hindus, when mingling together, they mingle as INDIANS, not as representatives of their religion. Had this happened in India including Muslims, there would not have been dispute over Babri, no Mumbai riots taken place, nor a fugitive landed in neighbor country and directed you guys with a remote control. Especially, there would not have been youth growing with hatred towards Hinduism. Count one member turned against Hindus from Farsis, Jains, Budhdhists or Christians ?? This is the perfect example in front of you !

    Gujarat riots are partly result of such segregation and you are partly responsible. Other part is of-course the result of this, I am sure you don't expect me to point it out to you, have the intellect to assume it.

    As such, do you have guts to get away from your fanatic leaders and live a life assimilated with other communities ? Impossible. When you do it, you will yourself voice for termination of TT. You will not say 'Haaan jeee' and will stop living on suppressing women of your own family !

    Stupid suggestion. Think that the changes is done so that your daughters won't suffer, don't think that you will loose to practice your superiority and power over women. When you do that, you will be happy for the changes.

    TT is in bad taste....it started 1400 years ago...unfortunately at that time society was male dominated...and full of wars...its time to change according to present time...Its human tendency to resist change...especially those who loose power...in this case men...

    What I found in Middle East...Arab Muslim divorcee women have less stigma than us... and pretty much treated in par with spinsters...In gulf first marriage is normally between very young girls and relatively older men....but second innings, which is very common mostly of same age and between mature men and women...which are pretty much like our marriages,,,which last longer ......Normally at home women are bosses...outside men dominate...Women's behavior in gulf countries changes drastically after first marriage...which happen at very young age...mostly teen age...once they are married they are more liberal and open minded...

    Muslim women also have equal right to end the marriage contract. That is called khula.
    According to one recent study, more than 40 % of the muslim marriages which ended in divorce were initiated by the wives.
    And according to another study between 2011 and 2015 the divorce rate for muslim couples was 5.6% and that for hindus was 7.6%.
    And the rate of re marriage of muslim women after divorce is much higher than hindu women. They are free to marry anybody after a period of about 3 months.

    In other religions marriage is annulled for some very extra ordinary reason and the the divorced person normally doesn't marry because that person is not a marriage material but the divorcee can remarry. But in Islam divorce is well structured and both able and normal people can remarry to some other person. There is no binding and commitment towards each other, so any time anything can happen. This will definitely have very bad effect on the children and then the society.

    Marriage contract is totally different issue. Normally in Islam if a man says 3 times Talaak that's the end of the marriage whether that woman is aware of it or no. The man has all the previlege and say on the matter.
