Pune techie's gangrape, murder: Court gives death to all 3 convicts


Pune, May 9 (PTI): A Pune court on Tuesday awarded death sentence to three convicts in the 2009 Nayana Pujari gangrape-cum-murder case.

Three men on Monday were convicted by a special court here for the kidnap, gang-rape and murder of a software engineer in 2009.

Special Judge L L Yenkar also held the trio—Yogesh Raut, Mahesh Thakur and Vishwas Kadam--guilty of robbery, misappropriation of property (possessed by the deceased) and criminal conspiracy.

The prosecution said that the case was fit for the 'rarest of rare' category.

A software engineer from an IT firm in Kharadi was kidnapped on the evening of October 7, 2009, from Kharadi bypass, when she was waiting for transport to go home.

Two days later, the 28-year-old techie's body was recovered from Zarewadi forest area in Khed tehsil of Pune district.

Investigations revealed that the victim was gang-raped in a car and robbed of cash by using her ATM card before she was strangulated and bludgeoned to death in the forest area.

Police probe later led to the arrest of four persons including one Rajesh Chaudhari, who later turned an approver in the case.

Special Public Prosecutor Harshad Nimbalkar said Chaudhari was acquitted by the court.

Also, when the trial was underway, main accused Raut escaped from the Sassoon Hospital here on September 17, 2011, while being escorted to the hospital for medical treatment. He was later re-arrested from Shirdi after 20 months. 37 witnesses were examined during the trial.

    Before hanging them all other other criminals and rapists should be brought to that site, and in front of them make public to hit them with police lathis one by one for half an hour for one week.

    It is this point that demonstrates the failings in the capital punishment system in India. Though the facts of both cases are substantially different, there are parallels between them.
    Both involve murders in cold blood.Just take the Bilkis case. The case involved the murder of 14 people, in cold blood, for no cause other than that they were Muslims. One of these was a three-year-old child, killed by smashing her head against a stone. It is not difficult to view this as being not only a rare case, but also one of extreme brutality.
    Both involve brutal sexual violence against women. Despite this, not only were the punishments for each case different, the manner in which the courts approached the matter of sentencing in the cases varied significantly.
    Unfortunately, these two judgments, delivered within few day of each other, are also representative of one of the biggest flaws in our criminal justice system: capital punishment.
    The decisions of the Bombay High Court in the Bilkis Bano case,Pune court in techie's rape and the Supreme Court in the Nirbhaya case should be a moment of truth.
    One nation. Two standard of judgement. Is Bombay court judges think 14 murders and rape is less criminal than pune and Nirbhaya case?

    SMR, this is the sad state of our justice system. Time to remove Lady Justice's blindfold and put weight on one side of the scale. When the judges are biased, whom shall we go for justice ?

    Justice ? Only for few ? What about Bilkis Bano case ? Gang rape and 14 murders ? Why no death sentence ? Mr. Lidwin, justice should not have religion.
