Aadhaar cannot be made compulsory for welfare benefits: SC


New Delhi, Mar 27 (PTI): The Supreme Court today made it clear that Aadhaar cards cannot be made mandatory by the government and its agencies for extending benefits of social welfare schemes.

A bench comprising Chief Justice J S Khehar and Justices D Y Chandrachud and S K Kaul, however, said that government and its agencies cannot be stopped from seeking Aadhaar cards for non-welfare schemes like opening of bank accounts.

The bench also said that a seven-judge bench needed to be constituted for authoritatively deciding a batch of petitions challenging the Aadhaar scheme on grounds including that it infringes on the Right to Privacy of citizens.

It, however, expressed inability in setting up of the seven-judge bench saying it would be decided at a later stage. Senior advocate Shyam Divan, appearing for one of the petitioners, alleged that the Central government is not following the various orders passed by the apex court that the usage of Aadhaar would be voluntary and not mandatory.

The apex court on August 11, 2015 had said that Aadhaar card will not be mandatory for availing benefits of government's welfare schemes and barred the authorities from sharing personal biometric data collected for enrolment under the scheme.

However, on October 15, 2015 it had lifted its earlier restriction and permitted the voluntary use of Aadhaar cards in welfare schemes that also included MGNREGA, all pension schemes and the provident fund besides ambitious flagship programmes like 'Pradhan Mantri Jan Dhan Yojna' of the NDA government.A five-judge bench headed by the then Chief Justice H L Dattu had also put a caveat in its interim order for the Centre and said, "We also make it clear that Aadhaar card scheme is purely voluntary and not mandatory till the matter is finally decided by this court, this way or the other way."

The bench, while including the four other schemes along with LPG and PDS where Aadhaar may be used, had said, "The Union of India to follow all other orders passed by this court since September 23, 2013."

The bench had also said that a larger bench was required to be set up for final disposal of the petitions that also include the question as to whether the right to privacy is fundamental right.

Divan, representing one of the petitioners who has challenged the Aadhaar card scheme, had claimed that the Unique Identification Authority of India (UIDAI), which runs the programme, is neither backed by any law nor by any notification and is getting biometric details through private agencies.

The lawyers for the petitioners had contended that the scheme is "all pervasive" and is not full proof either and hence, cannot be used for other programmes.

On October 14, 2015, the apex court took note of Centre's plea that Aadhaar cards be allowed to be used "voluntarily" for welfare programmes other than PDS and LPG schemes and asked whether it can assure that nobody would be at a "disadvantageous" position for want of Aadhaar.

    In October 2015, the Supreme Court made it clear that Aadhaar was voluntary and could not be made mandatory.

    “The Aadhaar card scheme is purely voluntary and it cannot be made mandatory till the matter is decided by the Court one way or another,” the order had stated.

    In September 2016, the Supreme Court once again reiterated this position. In fact, it sought an explanation from the government and asked it to remove a condition making it mandatory for the students to give their Aadhaar numbers for various scholarship schemes, despite a five-bench order that had restrained the Central government.

    Making Aadhaar mandatory to file IT returns ensures that this order is wilfully ignored and in fact seems to hold the Supreme Court’s order in contempt.

    On April 8, 2014, just a month before he took over as prime minister, Narendra Modi had this to say about Aadhaar:"On Aadhaar, neither the Team that I met nor PM could answer my Qs on security threat it can pose. There is no vision, only political gimmick".

    Today, under Prime Minister Modi’s government, the rules promulgated under the Aadhaar Act 2016, the Unique Identification Authority of India can file a first information report against any citizen who questions its security. What he called a political gimmick, a scheme without vision, has now become his government’s signature scheme.

    Nandan Nilekani, who joined the UPA government as the first chairman of the scheme, seems to have succeeded in creating the world’s biggest surveillance engine, ensuring that any government will have complete access to all the data of the citizen, and can use it to manipulate any one at will. Citizens have no protection against this surveillance any more. Section 32 of the Aadhaar Act ensures that under the guise of “national security”, the government can access any information without providing any explanation .

    Central govt now is trying to make compulsory for every thing Aadhaar Card. Even for driver licence , Aadhaar will be compulsory. A joke appeared in Mumbai Mirror as under:

    A Prisoner is already at the gallows with a doctor and a police, as a rule. At the right time, just before the hangman pulls the lever, judge comes and pronounces "Stop, this prisoner does not have an Aadhaar card".

    ..A pilot study conducted in 4 states un earthed nearly 2.5 lacs bogus students benefiting midday meal who are only in paper!!..Not only that, in Kerala’s department of general education,after Aadhaar numbers were integrated with the student database, found its schools to have an excess of 3,892 teachers. The state sanctions one teacher for every 45 students. Due to this exercise, no new teaching posts have been sanctioned in the state for the last two years. the notional savings achieved is estimated at Rs 540 crore per annum!!..even if its not mandatory, Govt should push for enrollment since fund saved can be used for larger benifit of people rather than ending up with malpractice r..

    SOMETIMES SUPREME COURT TALKS LIKE CHILDISH.

    AADHAR CARD SHOULD BE MADE COMPULSORY. BECAUSE IT REDUCES CRIME.

    IF A PERSON KILLS ANYONE. THROUGH FINGERPRINT . PERSONS FULL BIODATA CAN BE SEEN.

    I THINK IF CRIME REDUCES THEN THERE WONT BE MUCH CASES OF LAWYERS AND JUDGES. MANY WILL BE JOB LESS.
