Gang-rape Could have been Prevented: Chief Justice

New Delhi, Jan 3 (IANS): An incident like the brutal gang-rape here could have been prevented had the Supreme Court's guidelines on removal of tinted glasses from all vehicles been followed, Chief Justice of India (CJI) Altamas Kabir said Wednesday.

Inaugurating a fast track court in Saket district courts, Chief Justice Kabir said: "It's good to know that after the Dec 16 tragic incident, people have started raising their voice on crime against women."

The CJI expressed hope that the fast track court at Saket courts for dealing with cases of sexual abuse would be operational immediately.

Chief Justice Kabir said that a blame game after such incidents should be avoided as "it would not serve anything".

"A blame game will not serve anything. We have to go to the root of the problem. This case, which is in the public eye, should be decided as early as possible," he said.

The Delhi High Court had a few days ago agreed to open five fast track courts after the city government suggested so, following the Dec 16 gang-rape in a moving bus.

Chief Justice Kabir said four other fast track courts would be made operational in different parts of Delhi to show "we mean business in tackling matters of such nature".

Delhi High Court Chief Justice D. Murugesan, who was also present, said that judicial officers have been identified for the fast track courts and wherever possible, cases will be taken up for daily hearing.

    I totally agree with j9, mumbai. While there should be severe punishment on 100% cases the false cases also should be reverse-punished. If not, it is going to be a mess. Mr. j9 has an excellent vision on this. Thanks

    A THOUGHT AGAINST THE STRIDE!!!
    these days every body is talking about low conviction rate in rape & molestation cases, I wonder how the low conviction rates should be a logic for tougher laws? since every case is supposed to be judged by its own merit, OR are we hinting at giving conviction rates as a target to judges? as if it were a salesman's target of selling groceries!
    yesterday a Mumbai court found guilty a nexus of an struggling female model & an Asst inspector, the lady accused two businessmen of rape, both senior citizens, then she with help of the cop demanded them for a flat & a car for a "settlement" of the false rape charge.
    only passing tougher Laws is more harmful unless we've right people to implement them, simply drafting a document & passing it as LAW will only make "Rape" & "molestation" as a tool of extortion by unscrupulous elements including their female accomplices.
    such so called pro-women laws ultimately harm women too being the mother/sister of the falsely accused man.
    any such law should have a rider that if the accusation is found false then the so called "victim" should be given the same punishment as a rapist, since she rapes a man off his social & mental stability
    the age old thinking that "women wont lie" must be dumped since today's women are as equally capable, intelligent, ambitious as men so they are equally evil to succumb to greed, revenge either individually OR under duress of someones instigation under pressure OR as a member of a blackmailing racket.
    such criminals might use the called "tougher laws" as a shortcut to settle personal scores &/OR even as shortcut to settle disputes related to property that otherwise take decades in courts, one rape/molestation charge & the opposite party is put in lock-up without evidence (guilty unless proven innocent) by the time the guy proves his innocence he looses his social goodwill, business relationships & of-course a lot of money whereas the accuser has nothing to loose.

    these could have been and would have been things are worthless.
    Drastiic punishments like beheading in public will help a lot in discouraging rapists from even dreaming of such acts.

    My humble feelings
    1)Even without tinted glasses and/or lights inside, one cannot from the ground level see anything that is taking place inside the bus due to the height difference between ground and bus window.
    2)Also with the lights on inside the bus visibility for driver is affected.
    3)As regards four wheeler, the manufacturers themselves supply many cars with tinted glasses
    4)With the type of glaring mercury bulbs you cannot make anything that happens inside a car as you are blinded by the light
    5)My feelings is controls are also necessary against production of these bulbs& high decibel horns
    6)Law exists but number plates are still in all languages , fonts shapes etc that makes recording impossible in case of hit &run
    Unfortunately we have laws but implementation lags behind
    7)Then we have the people driving two wheeler like rockets and with modified silencers that make one go deaf. Parents should exercise control. Many may not have even license to drive.
    Cops should go to college entrance and check
    These may be my dreams. I request the learned judge to excuse for my opinions that has no bad intentions

    While I agree to what has been said about lawa enforcing agecy, it should also be realised seeing the trend in metro cities like Delhi during winters and New year eve's when people , in general, get drunk and show tendency towards unethical behaviour pattern. This is all the more reason for law enforcing agencies to deal such rouges scrupulously to ward off any danger to society at large.

    Dear Sir,
    Hon'ble CJI is absolutely right!In addition to ensuring removal of tinted glasses, it should also be ensured that buses are illuminated from inside with adequate light to make it visible. This is because even if you have plain glass but no light inside, and powerful light outside the vehicle, it will be still difficult to see what is happening inside.

    Against the rape there should be strong rule in our country, and that should be implemented properly. Administration should be always vigilant and keep patrolling in regular interval, And for the Delhi gang rape, Criminal should be punished as hang to death in an open place, so that people shuld see and learn a lesson and others wiil think twice before commit such an offence.

    that incident could have been prevented well in advance , if the bus was impounded by the transport authority when the driver and the owner committed the first crime, that is changing the permit rules to run a public transport bus..is it not the first.?

    It is truly right that the Blame Game is not the solution.Our govt should now work to stop heinous crimes like rape and take rapid decision for culprits of dec-16 rape case.Police,government and all the bureaucrats should ensure safety for girls avoiding any further cases like this one.

    I didn't agree to this, yeah but this will help to some extent to stop such cases, but definately that will not solve purpose in a big bus where this incident happened.

    1. ATTACK BY KASAAB & CO. ON TAJ IN WHICH 200 PLUS INOCENT PEOPLE DIED.

    2. SCAMS LIKE 2G, CWG,ADARSHA,COAL,THORIUM,TATRA,VADRA,DEWAAS,WALMART ETC...

    3. ATTACK ON WOMEN & CHILDRENS WHILE SLEEPING @ MIDNIGHT .

    4. REGULAR RISE IN PRICES OF PETROLEUM & ESSENTIAL PRODUCTS.

    5. UNEMPLOYMENT.

    6. HARASSMENT ON WHISTLE BLOWERS.

    7. APPEASEMENT OF MINORITIES FOR VOTE BANK.

    8. FALSE PROPOGANDA AGAINST SHRIMAAN NARENDRA MODIJI.

    9. ATTCK ON INDIANS IN FORIEGN COUNTRIES.

    10. LAST BUT NOT LEAST RULE BY FORIEGNER.

    Just removing tinted glasses from the vehicles is not the solution for the case. that all should be done later on. First of all take quick decision & punish the criminals in such a way, nobody can else ever think of doing a crime. Don't think of the criminals so much we all are aware what they have done. For this they should be hang to death..that is the only solution. Don't wait so long before it happens again.
